Nah, that's not how they should, think, at least. It was murder, when the law is applied correctly. And then the sentence is clear (in fact, the first Landgericht only sentenced him to 8 and a half years, which was overruled later).

He can try again after some period of time, even if his first motion was (finally) denied.
