Proscription and Sovereignty Act (2022)

An Act to prevent dangerous individuals from entering Thaecia.

PREAMBLE

Noting the danger of foreign agents entering the region of Thaecia to subvert her sovereignty, safety, or security,
Understanding the threat consistently posed to Thaecia as said foreign agents may freely enter Thaecia, even if the state knows they are a foreign threat, commit high crimes and misdemeanours, and be afforded the full protection of the law,
Recognising that said rights are important for the democratic security of Thaecia, and committed a free and fair trial, but realising that said high crimes and misdemeanours could be avoided entirely if they were proscribed from the region entirely,

Congress hereby agrees,

  • Section I - For the purposes of this law, defines:

    • Proscription - a decree issued that formally prohibits an individual from entering Thaecia or her dependencies,

    • Outsider - an individual who is not in any capacity a citizen of Thaecia,

  • Section I - A proscription may be issued by the Prime Minister, with the consent of a two thirds majority of Ministers, against any outsider, or group thereof, who pose a significant risk to the sovereignty, safety, or security, of Thaecia.

    • Section Ia - A proscribed individual may not enter the region of Thaecia with any of their own nations or shared nations; they may not employ a proxy to enter the region on their behalf.

    • Section Ib - Proscriptions may not occur unless there are at least four currently serving Cabinet Ministers.

  • Section II - All proscriptions must be issued publicly, unless it is believed by two thirds of Ministers that a public issuing would harm or increase the risk to the sovereignty, safety, or security of Thaecia, in which case the proscription must only be informed to Justices of the High Court.

    • Section IIa - Deputy Justices do not need to be informed unless they are currently serving as a stand-in for another Justice.

  • Section III - Any proscription may be, at the will of the High Court, subject to judicial review to determine the necessity and legality of the decision.

    • Section IIIa - Such a hearing may be conducted in private if the Court wishes to do so.

  • Section I - A proscription may be revoked at any time by the Prime Minister, with the consent of a two thirds majority of Ministers.

  • Section II - The High Court may revoke a proscription in the event that the proscribed outsider(s):

    • Section IIa - were in any capacity citizens of Thaecia at the time of their proscription;

    • Section IIb - did not pose a significant risk to the sovereignty, safety, or security, of Thaecia.

  • Section I - In the event that an individual or group thereof are proscribed when they do not pose a significant risk to Thaecia, and this is done in mens rea knowing that they do not pose such a risk, the nations who did so willingly in actus reus will be considered guilty of an offence at the level of a Felony, as defined by L.R. 044, and should be punished in the same manner.

  • Section II - In the event that an individual or group thereof are proscribed without the approval of the Prime Minister and/or a two thirds majority of Ministers, the nations who did so willingly in mens rea and actus reus will be considered guilty of an offence at the level of a Felony, as defined by L.R. 044, and should be punished in the same manner.

  • Section III - In the event that an individual who is proscribed from Thaecia attempts to enter the region or her dependencies, or attempts to employ a proxy to do so on their behalf, they shall be immediately banned from the region(s) in question.

Amends Article VII - Citizenship, to read as follows;

  • Section I - To be granted legal status as a Citizen, a resident of Thaecia must be in the World Assembly.

    • Sub-section I - The requirement to be in the World Assembly shall be waived if the resident can prove to the President, the Prime Minister, or the Minister in charge of Domestic Affairs that their World Assembly nation resides elsewhere and they have a non-WA puppet in Thaecia.

  • Section II - No individual may have more than one nation holding Citizenship.

    • Sub-section I - If the Prime Minister, the Chief Justice, and a 2/3rds majority of Ministers agree; the Prime Minister may revoke an individual's Citizenship if the individual has multiple nations holding Citizenship; any revocations made under this sub-section are subject to immediate judicial review to determine the legality of the decision.

  • Section III - Citizenship is a requirement for holding the offices of World Assembly Delegate, Prime Minister, Deputy Prime Minister, Minister, Senator, Member of Parliament, Chief or Associate Justice, Deputy Justice, and Electoral Commissioner.

  • Section IV - An individual who is in any capacity prohibited from accessing the region of Thaecia will not be permitted to hold citizenship on their banned nation or any puppet nations. Any such nations must be removed from the region for the duration of their prohibition.

Amends L.R. 044 Article VIII, and Article IX, to include,

12. Refusal to Obey Subpoena - A person is guilty of this offense if they fail to meet the expectations of a subpoena within 14 days of its enactment.

13. Ban Evasion - A person is guilty of this offence if they attempt to enter Thaecia or her dependencies during the course of their proscription or ban from Thaecia.

1. The following shall be designated as High Crimes:
Treason, Espionage, Sabotage, Voter Fraud, Ban Evasion;
For High Crimes, there is no Statute of Limitations, and punishments may be issued up to an indefinite ban.

Article I - Rules
Presiding Authority

  • Section I - The Prime Minister or their designee is required to maintain an easily accessible set of rules for Thaecia's Regional Message Board. This is to be shared will all new nations;

    • Sub-section I - These rules must ensure the rights of the citizen under the Constitution of Thaecia are upheld.

Mandatory Rules

  • Section II - The following rules must be included in the rules maintained by the Prime Minister;

    • Sub-section I - Any content in violation of site rules.

    • Sub-section II - Content that is gory, obscene or vividly sexual, or otherwise PEGI 18.

    • Sub-section III - Content intended to offend people on the basis of their ethnicity, gender, sexual orientation or religious affiliation.

Article II - Suppression and Ejection

  • Section I - A Regional Moderator may use suppression as they see fit to enforce the rules maintained by the Prime Minister or their designee;

    • Sub-section I - This may include the use of blanket suppression, in a scenario where a Regional Moderator believes the behaviour of the suppressed individual in question warrants blanket suppression.

  • Section II - Ejections or Bans from the region may only be used to enforce the rules in the following circumstances;

    • Sub-section I - The individual has been issued a permanent ban from the regional discord server.

    • Sub-section II - The individual has broken any of the rules explicitly stated within Article I, Section II.

    • Sub-section III - The High Court has ruled that the nation is to be ejected and/or banned from the region for their conduct on the Regional Message Board.

  • Section III - Ejections, Bans or Suppressions may be subject to appeal;

    • Sub-Section I - In the event where the individual appealing is subject to suppression only, they may submit a request the Prime Minister to review the ruling of the Regional Moderator. The Prime Minister may reaffirm or overturn the ruling made.

    • Sub-Section II - In the event where the citizen appealing is subject to a ban for the reasons defined in Article II, Section II, Sub-sections II & III, their appeal must be to the High Court. The High Court may overturn the ban, choose to amend its length, or reaffirm the original ruling.

    • Sub-section III - In the event where the individual appealing is subject to a ban for the reason defined in Article II, Section II, Sub-section I, their appeal must be to the relevant moderating authority of the Regional Discord.

Article III - Definitions

  • The "Regional Discord" is defined as the discord server with the ID 537409732701585418.

  • A "Regional Moderator" is defined as a Regional Officer with Communications permissions or Border Control Authority.
