In my opinion, a good candidate is one who refuses to say any bad things about their opponents out of mutual respect. This does not seem like a place of mutual respect. How do we trust you in such an exalted position after you express such a lack of respect?

13.. You say Obets has a “lack of goal substance”, when you yourself remain vague and limited in your goals and explanations. I guess my question here is What gives?

Not right now, but I do expect some inconsistencies will show up. In such a case, I will do what the president says - that's the only way. On the outside, we'll look completely of one mind, as such things are resolved quickly and simply - by personal communication. It will definitely not interfere with productivity in any way, on the contrary; I believe bringing more opinions and ideas into place always helps to focus on the most important things that, in the end, get implemented. A discussion about what way should something go - I'm speaking very generally here - is almost always for the good. I'm not worried about that at all, I know my place, and do not wish to rise above it.

RL-014, Amendment to Criminal Code



Preamble:

ACKNOWLEDGING: that Lying on a Citizenship Application is currently a high crime

UNDERSTANDING: that the maximum sentence is currently lower than the maximum sentences of all the felonies despite the fact that it is a high crime

BELIEVING: that Lying on a Citizenship Application should be reclassified as a Felony

NOTING: that an amendment to the Criminal Code is required for this

This piece of legislation hereby amends/ the following:
High Crimes:

  1. 1) Anyone who:

    (i) levies, attempts to levy, incites others to levy, or attempts to incite others to levy war against FNR;

    (ii) seizes, attempts to seize, incites others to seize, or attempts to incite others to seize a position unlawfully; or

    (iii) uses, attempts to use, incites others to use, or attempts to incite others to use the powers of any position gained unlawfully

    is guilty of the offense of Treason under this law and liable to punishment up to a maximum sentence of an indefinite ban.

    (2) Anyone who:

    (i) aids, attempts to aid, incites others to aid, or attempts to incite others to aid enemies of FNR in a time of war; or

    (ii) rebels, incites or attempts to incite rebellion against the FNR civilian government or the chain of command of the FNDA from within FNR or outside of it

    is guilty of the offense of Sedition under this law and liable to punishment up to a maximum sentence of an indefinite ban.

    (3) Any citizen, resident, or member of FNR who, with the intent to damage or destroy the relevant communication platform:

    (i) undertakes any action which could cause a communication platform to go out of service or lose information, including but not limited to: the deletion of posts, the deletion of forums, a denial of service attack, or any other act of this kind;

    (ii) undertakes, or attempts to undertake, any action in a region in which they are not a resident to waste space on forums or to cause forums to crash, including any attempts to force a denial of service error on any communication platform;

    (iii) undertakes, or attempts to undertake, any attempt to flood the RMB of a region which is not their normal abode;

    (iv) gains, or attempts to gain, controls or obtains passwords to communication platforms by deception, especially by posing as administrators or moderators;

    where communication platform includes but is not limited to any forum, website, Wiki pages, or instant messaging platforms owned or maintained by FNR or attempts to do so, is guilty of the offense of Off-site Terrorism and is liable to punishment up to a maximum sentence of an indefinite ban.

    (4)Anyone who:

    (i) conceals previous regional affiliation(s) on their citizenship application;

    (ii) conceals previous alias(es) used in other regions or in FNR when applying for citizenship; or

    (iii) provides misleading or deceitful information in an attempt to obtain through deceit or deliberate silence or omission citizenship in FNR, or more than one account with citizenship,

    is guilty of the offense of Lying on a Citizenship Application under this law and liable to a punishment at judicial discretion not exceeding an six (6) month ban.

Felonies:

  1. (4)Anyone who:

    (i) conceals previous regional affiliation(s) on their citizenship application;

    (ii) conceals previous alias(es) used in other regions or in FNR when applying for citizenship; or

    (iii) provides misleading or deceitful information in an attempt to obtain through deceit or deliberate silence or omission citizenship in FNR, or more than one account with citizenship,

    is guilty of the offense of Lying on a Citizenship Application under this law and liable to a punishment at judicial discretion not exceeding an six (6) month ban.

    (5) (a) Anyone who attempts to force someone to provide favors of material or substantive value or undertake actions with a threat to release incriminating, compromising, or injurious information, which is not widely known in FNR, is guilty of the offense Blackmail under this law and liable to a punishment at judicial discretion not exceeding an eight (8) month ban.

    (6) (b) Anyone who attempts to force someone to provide favors of material or substantive value or undertake actions with a threat to release untrue information, is guilty of the offense Extortion under this law and liable to a punishment at judicial discretion not exceeding an eight (8) month ban.

    (7) Anyone who represents, attempts to represent, or purports to represent FNR in an official capacity in a domestic or foreign environment without proper legal authorization is guilty of the offense of Unlawful Representation under this law and liable to a punishment at judicial discretion not exceeding an eight (8) month ban.

    (8) Any Moderator or Administrator who:

    (i) deletes or edits any message without authorization from the Court or just cause;

    (ii) deletes or edits a user account, or the information contained within, without authorization from the Court or just cause;

    (iii) alters or attempts to alter moderator or administrator logs;

    (iv) uses or attempts to use administrator or moderator powers to assist a criminal act; or

    (v) commits other actions unbecoming of an administrator or moderator

    is guilty of the offense of Abuse of Administrative Powers under this law and liable to a punishment at judicial discretion not exceeding an eight (8) month ban.

    (9) Anyone who alters FNR law in a manner not allowed for in other Legislation, alters historical documents without authorization from the Court and the appropriate documentation, or deletes either of those historical properties, is guilty of Damage to Historical Property under this law and is liable to a punishment at judicial discretion not exceeding an eight (8) month ban.

    (10) Anyone who accesses another members account without the express permission of the member is guilty of Profile Trespassing under this law and liable to a punishment at judicial discretion not exceeding an eight (8) month ban.

    (11) Anyone holding a gameside delegate position who exercises gameside functions, such as the delegate’s vote, obtained due to their position as gameside delegate in contradiction of lawful FNR legislation is guilty of the offense of Unauthorized Use of Gameside Delegate Functions and liable to a punishment at judicial discretion not exceeding an eight (8) month ban.

    (12) Anyone who impersonates or attempts to impersonate another individual, or falsely represents or attempts to represent an organization or entity is guilty of the offense of Identity Fraud under this law, and liable to a punishment at judicial discretion not exceeding an eight (8) month ban.

    (13) Anyone who:

    (i) sends unauthorized recruitment or welcoming telegrams, or authorized telegrams with unauthorized edits;

    (ii) recruits from a region other than a Game-Created Region without authorization;

    (iii) recruits from any region contrary to treaty law;

    (iv) falsely reports, or causes software tools to falsely report, a telegram count to be included in official government records or processes; or

    (v) otherwise interferes with recruiting or welcoming efforts

    except in pursuit of a legitimate government interest, is guilty of the offense of Unlawful Interference with Recruitment or Welcoming under this law, and liable to a punishment at judicial discretion not exceeding an eight (8) month ban.

    (14) Anyone who communicates an untrue and potentially injurious statement about another person or entity with the intent to injure that person or entity to a third party shall be guilty of the offense of Defamation, and is liable to punishment at judicial discretion not exceeding an eight (8) month ban.

    (15) Anyone who:

    (i) shows repeated disregard for the proper procedures of the Court;

    (ii) purposefully disrupts, derails, or otherwise disturbs the order within the Court;

    (iii) fails to follow the orders of the Presiding Judge within the Court;

    (iv) provides false information to the Court; or

    (v) fails to follow a court order or sentence

    is guilty of the offense of Contempt of Court and is liable to a punishment at judicial discretion not exceeding an eight (8) month ban.

    (16) Anyone who commits multiple or frequent misdemeanors is guilty of the offense of Repeated Misdemeanors under this law and is liable to having their offenses upgraded to a Felony by the Justice presiding over such a case and punishment at judicial discretion not exceeding an eight (8) month ban.

    (17) Anyone who provides or offers anything of monetary value to an individual or group in an attempt to influence an election or appointment is guilty of the offense of Bribery under this law and is liable to a punishment at judicial discretion not exceeding an indefinite ban.

    (18) Anyone who posts, sends, or uses pictures or text that a reasonable person would consider vulgar, profane, lewd, or unacceptably graphic in nature on the FNR Forum, RMB, or other areas regularly considered as territory of FNR, or directed towards another FNR member without express consent, is guilty of the offense of Breach of Community Standards and is liable to a punishment at judicial discretion not exceeding an eight (8) month ban.

    (19) Except as otherwise provided by law or by this Act, anyone who attempts to deceive the government of FNR by making a materially false, fictitious, or fraudulent statement, or by omitting, concealing, or hiding a material fact in an interaction with the government, including in official election filings or confirmation hearings, is guilty of Making False Statements, and liable to a punishment at judicial discretion not exceeding a ban of 8 months.

Misdemeanors:

  1. (20) Anyone who commits multiple or frequent infractions is guilty of the offense of Repeated Infractions under this law and is liable to having their offenses upgraded to a Misdemeanor by the Attorney General or Justice presiding over such a case and punishment at judicial discretion not exceeding a one (1) month ban.

    (21) Anyone who publicly advertises membership, directly or through prolonged conversation, of a foreign region or areas not operated by the administration or government of FNR, to FNR citizens, unless in furtherance of a legitimate governmental interest, is guilty of the offense of External Recruitment, and liable to a punishment at judicial discretion not exceeding a ban of seven (7) days.

Infractions:

  1. (22) Anyone who, in any other area not designated to allow spamming, undertakes any action that:

    (i) wastes space, including through repetitive posting or messaging, in a way that a reasonable person would conclude does not add even a minimum of value to the discussion, whether by advancing the discussion, expressing an idea, or through some other way; or

    (ii) makes repeated posts or messages in a thread, channel, or equivalent area with a publicly posted and explicit purpose in a manner disruptive to normal administrative or governmental function

    is guilty of the offense of Unlawful Spamming and is liable to a punishment at judicial discretion not exceeding Community Service.

    (23) Anyone who engages in frequent, prolonged, or ongoing behavior that a reasonable person would consider unacceptable to the community including offensive language, insinuations of threat, or directing unnecessarily hostile language at an individual is guilty of the offense of Fostering a Hostile Environment under this law and is liable to a punishment at judicial discretion not exceeding Community Service.

Statute of Limitations:

  1. (24) For High Crimes, there is no Statute of Limitations.

    (25) If a charge of a Felony is not submitted to the Court within 180 days of the date that the alleged crime occurred, the charge may not be pursued.

    (26) If a charge of a Misdemeanor is not submitted to the Court within 30 days of the date that the alleged crime occurred, the charge may not be pursued.

    (27) The Statute of Limitations for Aiding and Abetting a Crime shall correspond with the class of crime that was aided and/or abetted.

    (28) The Statute of Limitations may be waived by the Court if it believes that the Case could not have feasibly been brought earlier.

Jurisdiction:

  1. (29) The Courts of FNR will also have Jurisdiction over all actions on the region page of FNR, the forum of FNR, and any other venues maintained or provided by the government of FNR, as well as any actions of an individual outside of these venues if those actions cause injury to a Citizen or the Government of FNR.

Mens Rea:

  1. (30) A person shall be considered guilty if they have fulfilled the objective element of a crime. A defendant may exculpate themselves by proving they did not intend to commit the prohibited act.

Aiding Criminal Acts:

  1. (31) Anybody who willfully aids, counsels, commands, induces or procures the commission of a crime is guilty of Aiding and Abetting a Crime and is liable to a punishment at judicial discretion not exceeding the maximum punishment for that crime.

Additional Penalties:

  1. (32) Any conviction of a high crime, felony, or misdemeanor may result in the removal of the convicted defendant's Citizenship at the Court's discretion via a unanimous decision.

Rule of Lenity:

  1. (33) The Court shall follow the judicial doctrine of the Rule of Lenity which holds that a court is required to apply a criminal law that it finds unclear or unambiguous in the manner most favorable to the defendant.

Administrative Permissions:

  1. (34) Whenever the safety and security of the FNR and its members is under threat the moderators and administrators may respond with moderation efforts against a nation when high crimes, the violation of terms of service, or other strongly disruptive behavior is ongoing at discretion of the moderators. The banned nation upon which action was taken, may appeal their ban to the Court and upon doing so they shall be subject to the same constitutional and statutory rights as any other offender.

Preamble:

ACKNOWLEDGING: that The Free Nations Region is a member of the Partnership for Sovereignty, a Security Council voting bloc.

UNDERSTANDING: that amendments made to the Charter of the Partnership for Sovereignty must be approved by the legislatures of all of its member regions.

HOPING: that the legislature of The Free Nations Region will provide its approval of the following amendment to the aforementioned Charter.

This piece of legislation hereby amends the following:

Below are two excerpts from the Partnership for Sovereignty Charter with the appropriate revisions applied to them. The full Charter can be viewed here.

Section II: Setting Voting Recommendations

  1. Each member region may appoint a delegation to participate in private discussions about voting with other member regions of the Partnership for Sovereignty. Each delegation shall have one vote in decisions of the Partnership for Sovereignty.

  2. Any representative to the Partnership for Sovereignty may request that the Partnership set a recommendation on a vote for any Security Council proposal prior to on site voting based on the idea such a vote recommendation will fulfill the values in Article I.

  3. After discussion, any representative may motion for a vote on a vote recommendation, such a vote will last 24 hours or until all members have voted. A vote recommendation includes the option preferred by the parties and the reasoning published for the recommendation. In order to issue a recommendation, a quorum of one-half of delegations must be reached, and three-fifths of non-abstaining 60% of voting representatives must support the recommendation representatives must support the recommendation. If the proposed vote recommendation does not reach these thresholds this threshold, the Partnership will not issue a vote recommendation on that Security Council proposal.

  4. After a vote recommendation is issued, the recommendation will be published in a NationStates Dispatch for public viewing. Members are encouraged to further distribute the recommendation through appropriate methods to ensure the citizens of the member region are made aware of the vote recommendation.

  5. Once the relevant Security Council proposal reaches a vote, the Delegates and World Assembly residents of member regions are strongly encouraged to vote in line with the Partnership’s recommendation.

Section IV: Membership Guidelines

  1. Any region that wishes to join the Partnership for Sovereignty must contact the responsible authority in a member region to request entry to the Partnership. The member region’s delegation must present the question of the region’s admission to the Partnership for Sovereignty. By requesting admission to the Partnership, a region agrees to abide by the terms of this Charter if admitted.

  2. Following discussion of the application, a 72 hour vote will be held and, if three-fourths of non-abstaining delegations concur, with a quorum of one-half of voting delegations voting delegations concur, the region shall be admitted.

  3. Should an application vote fail to reach quorum, discussion of the application shall continue for one week, after which a second vote is held. Should the second vote fail to reach quorum, the application is automatically rejected.

  4. An existing member of the Partnership shall be automatically expelled if they declare a formal raiding alignment.

  5. An existing member of the Partnership may be expelled for any reason if three-fourths of voting delegations concur in a 72 hour vote. A member region may not vote on its own expulsion.

  6. An existing member of the Partnership may withdraw at any time.

Maybe we may be able to merge all of the periodical telegrams into 1, so it's not so overwhelming, or send them in different phases, like 1 of them on the 1st, another one on the 10th, and the 20th; but that would require coordination with the rest of the government, which shouldn't be a big issue eitherway.

So, I'd put it to update dispatches required, and to update the government's calendar(events related to the legislature of course), with other duties possibly coming up throughout the term, and the most important of all, would be in the case I'm unable to fill my duties(such as if I went on LOA).

1.. I'm quite delighted you're asking "Why" instead of "How." Explaining the how should be the focal point of my campaign, which distinguishes it from my opponent -- its' substance. Honestly, I did not run for a second term for the same reason that the last few presidents have only been there for one term. It's a significant time investment and I accomplished the majority of my proposed ideas. It was quite a revitalizing time then. Most certainly do I stand by the fact that my term has carried on to other administrations and therefore my momentum is persistent. This is why I put such a major focus on setting traditions in stone via legislation. For example, the monthly transparency report, an up-to-date agenda, a regional calendar, on-time monthly updates of good quality, et cetera. You get the point. These are things I have legislated and continue even in My Nation's current administration. At the release of each monthly transparency report, I feel satisfied and proud knowing I have impacted the whole region positively in the long-term. I am prepared and am ready to be a public servant again. At the time, I can provide the surety of enough IRL time to deliver results.

2.. As with my previous term and my judicial background, I encompass the "long term success and prosperity" by setting new traditions in stone via legislation as mentioned earlier. One of them even includes the word "Standardization" in the title. Therefore, I can prove my interest in the betterment of the region and that I stand by my campaign statement that I consistently repeat. Though, as a President, I am able to lead and achieve my proposed ideas with much more momentum and be able to more efficiently jumpstart traditions. In addition, this opens up the whole team for collaboration (Cabinet and various staff.)

4.. I do not believe this deserves to be blamed on Sparsdan. It's simply an FNR way of doing things. Nonetheless, this can be a turning point for a greater initiative. I find it wrong how opportunities are posted all over the place and rarely re-posted. I find it wrong how we have many unused dispatches. I find it wrong that we have outdated materials on- & offsite. I clearly outline in my campaign the exact steps I wish to take to tackle this. No broad promise.

5.. Random as in (1) a minister must take their own self-initiative, (2) re-posts are rare and therefore the opportunities are often missed, (3) there is no centralized register. Aside from this, the random job listings tend to lack detail. Again, I outline the steps to tackle this in my campaign.

6.. At the current moment, we tend to have about two telegrams per month. Usually, ones mandated by law (i.e. transparency report.) I'm still very open to any modification of the timeframe between telegrams. Perhaps three weeks would be more fitting. Either way, I do firmly believe we should send them at a specific interval. It's a common NationStates complaint that players don't understand what they can do and how to achieve that goal.

7.. I would disagree on "so many" in FNR. Lately, more updating has occurred. In addition to that, I'd like to specifically focus on merging data. Removing the excess and create a easy-to-follow pagination.

8.. My campaign encompasses much more. But a WA program and its associated numbers are a big factor in regional stats. In addition, this opens up and broadens more opportunities for my citizens. In this election, there are also more WA opponents with substance. In addition, I am not particularly passionate about the resolutions aspect of the World Assembly which does not incentivize me to run for the office. Nonetheless, I understand its importance and opportunities.

9.. I'm looking to be quite lenient on this and see it as a method of stimulating activity. Lenience in the terms of not needing to pass. Following the steps from drafting to posting and receiving feedback from the NSGP, to submission. In fact, I think it is essential a delegate has attempted this process before they can help others. So, in addition, it also adds to a delegate's qualifications.

10.. The terms and conditions of who receives credit must be laid out in advance -- I am assuming this would be the WA delegate in the majority of circumstances as it is lead by him. Others are to be credited as is required by site rules on plagiarism and our own morals. This should be seen as something new and unique, a teaching experience, and a fun regional activity with a potential real impact on the entirety of NationStates.

11.. I outlined what is missing and what will change. My experience in other regions has shown me and inspired me to what more can be done. Of course, we need to put in the hard work. In addition to Drehtisch, I am also able to help code this. I have coded the verification system we use in Discord's #immigration channel. While I am far from being as experienced as Tigerania, I can be a big help to this particular development.

12.. I'm lenient in their freedoms. I would just like constant communication and a review of major developments (e.g. each foreign update). I will be clear in outlining the administration's agenda and finding a compromise with their goals.

13.. They are just words and numbers. But it is these words and numbers that have inspired me and shown me very different perspectives. I have the perspective of different regional activities and the quality they should entail. I have the perspective of legislative standardization. I have actively participated in the perspective of a developed endotarting program. This allows me to more accurately assess ourselves and translate hardwork from the good experiences I have seen and participated in.

14.. I do not plan on any major changes to the makeup of positions. I intend to keep the ministries (in fact expand on their workload,) have an undefined number of advisors, and consider transitioning the regional newspaper to a ministerial position as it is a big duty.

I will uphold the same quality expected of me in my last term with the traditions set. President 2021: Choose Heaveria!




It’s this April 2021 that I announce my bid to become your president for a second term and to build upon the progress of my last term. Much of the revitalization continues until today. Though, I am certain that more can be done and we can be more than stagnant. I am also certain we can set ourselves up for long-term success and prosperity. It is fundamental that we put a focal point on our new members. Through legislative standardization and new traditions, we can ensure that my administration's unique policies centralize and ease the access to opportunities, will continue for multiple generations. We will put an effort into the future blood of FNR.

In addition to the focal point of new members, we need a push out of stagnation and have an increase in our workload. Our World Assembly program has seen few new ideas or implementations of those ideas. Tyulenistan and I have a clear idea of where the WA can head, that we will outline. We also believe that the workload of our ministers is light and can seem slow at times. Unique policies will be implemented to ensure activity whilst assigning more duties in certain ministries.

Centralization & Ease-of-Access
Why? At the moment, things often seem scattered or out-of-date.

Jobs & Oppertunities
Posts about job opportunities are often random and easily missed. We need to simplify the process of showing new people opportunities and how to act upon them. For that, we need to centralize our job listings. That entails:

1. Consistently updated dispatch for job opportunities.
i. With accurate descriptions and a clear path on how to obtain the job.
ii. To include a centralized area for the Apprenticeship Program.

2. Merge apprenticeship information into the Jobs & Opportunities Dispatch

3. Dedicated spot in Discord with all listings.

4. Biweekly prepared telegrams outlining potential opportunities.

Dispatches
For many many administrations, we have promised to simplify and get all dispatches up-to-date. While progress has been made, we must strategically tackle this issue so we can achieve satisfying results.
1. Most importantly, create a schedule with set deadlines. The schedule will span the administration, but depending on staffing could be largely accelerated.

2. Establish a centralized method for requesting dispatch updates. The initial idea is a Google Form, where anyone (especially ministers) can request their changes to dispatches. This keeps a clear queue and logs that allows focused work and oversight by the President.

WA Program
Our WA program has been stagnant for far too long. There are various routes of inspiration to put on our future WA delegate. Unfortunately, our WA program operates on the bare minimum of voting, when there is so much more that can be done.

1. A centralized archive of our decisions in a dispatch with a reason. A prime concept in many well-developed regions.

2. Posting our decisions to vote on WA resolutions on the NSGP forum. This will additionally raise our order in the list of regions and have us stand out more often causing a bump in foreign affairs.

3. Introduce legislation that would mandate the WA delegate at minimum attempt to author WA resolutions.

4. Region-Wide authored resolutions! Not only would bright minds collaborate together and overcome creative roadblocks, but this would be a fun innovative event in which the region collaboratively authors a resolution. This could show to be a door to sparking interest.

5. Majorly enhanced endotarting program. Endotarting is the act of endorsing many nations at once. This would be a two-part program. (1) Through the help of custom code and our bot developer, we could make it easier to receive the list of endorsable nations and receive a direct link to said nation. (2) Through more custom code, we can set up a system in which the WA delegate and his staff are able to filter out new nations that have joined our region. Through this, nations who do not yet endorse the WA can be targeted with telegrams. Not only does a raise in WA numbers positively reflect on the region, but it can a factor in keeping people interested on-site leading to more members.

Foreign Affairs
In order to grow and be successful, it is imperative that the FNR constantly assesses our relationships with other regions in order to focus on those regions that are eager to demonstrate bilateral cooperation. While the FNR has made strides when it comes to our relationship with other regions there are actions that can be taken to strengthen higher-value relationships.

1. Prioritize reciprocal relationships. shutting down embassies, which offer little strategic value to the FNR and that are invaluable partners who cause time-consuming upkeep, can help the region strengthen ties with more beneficial relationships.

2. Appointing ambassadors. In an effort to build a broader coalition of representatives for the region it is imperative that all ambassador positions are filled with knowledgeable and enthusiastic people. The Job & Opportunities Program will help fill positions as needed.

3. Interregional communication and relationship building. By ensuring that monthly updates are posted and that the Ministries of Foreign Affairs and Culture work in conjunction to host relationship-building possibilities that bilaterally help both us and our allies.

Unique Policies
If we are to be a Catalyst for Progress, we must stand out and make bold policy decisions:

1. 8-Day Vote-of-no-Confidence Policy. If a member of government is inactive for 8 days, an automatic Vote-of-no-Confidence shall be submitted to the speaker. As is standard procedure, the people will be able to vote on this. We will remain very empathetic and understanding to those who need to take a Leave of Absence and there will therefore be an exception. Though, we must remain consequent to those who aren’t part of the regions continuing progress.
