A speech by the General-Secretary of the Communist Party of Patagonia and the Southern Dependencies titled “On the dangers of the World Assembly and the cult of Max Barry.”

¡Camaradas! En el informe del Comité Central del Partido en el 90 Congreso del Partido y en varios discursos de los delegados al Congreso, se ha dicho bastante sobre el culto a la Asamblea Mundial y sobre sus nefastas consecuencias.

Desde la formación de la Asamblea Mundial, el Comité Central ha dudado en confiar en ella en cualquier asunto que se le haya planteado y se ha resistido activamente a seguir cualquier resolución que haya intentado imponernos. En nombre de la preservación de la obra de Marx y del difunto camarada Esteban, hemos actuado en los asuntos que hemos considerado necesarios para preservar nuestra cultura y modo de vida. La Asamblea Mundial también ha generado un culto a la personalidad en torno a Max Barry, que se esfuerza por modelarlo con características sobrenaturales, semejantes a las de un Dios. Fueron tales ideales los que nos llevaron a condenar a Max Barry en 2008 en el 74º Congreso del Partido.

Tales creencias y actividades, específicamente en torno a aquellas creencias y actividades que amenazan los ideales del marxismo y aclaman a Max Barry como un Dios, se han cultivado entre las naciones durante muchos años.

El objetivo del presente informe no es una evaluación exhaustiva de la Asamblea Mundial ni del propio Max Barry. Tales materiales ya han sido escritos desde el extranjero. El presente informe se refiere a la cuestión de que la Asamblea Mundial está profundamente corrompida y tiene como objetivos extender esa corrupción y acabar con el comunismo a escala mundial.

En las últimas semanas, la corrupción de la Asamblea Mundial se ha puesto de manifiesto ante el mundo cuando el representante de Wallenberg fue destituido de su cargo sin previo aviso ni razonamiento público. Con ello, la Asamblea Mundial ha demostrado ser una fuerza de nepotismo y capitalismo, convirtiéndose así en una amenaza para los inquilinos por los que luchamos hace casi un siglo. Pero estas no han sido las únicas acciones corruptas de la Asamblea Mundial, una y otra vez se ha mostrado favoritismo hacia ciertas propuestas, a los miembros más nuevos se les niegan las mismas o iguales oportunidades que a los miembros más veteranos. Esto ocurre mientras la Asamblea Mundial se autoproclama como un lugar donde todos pueden tener voz. Pero, ¿cómo pueden todos tener voz cuando a algunos se les permite ser escuchados más que a otros? Es hipocresía.

En la actualidad, nos preocupa una cuestión que tiene una inmensa importancia para el Partido y la nación ahora y para el futuro: cómo ha ido creciendo gradualmente el culto a la persona de Max Barry, el culto que se convirtió en cierta etapa específica en la fuente de toda una serie de perversiones sumamente serias y graves de los principios que deseamos defender, de los principios antidemocráticos, de la legalidad revolucionaria.

El Partido y la Nación tienen ante sí dos opciones en este asunto, cada una tan peligrosa y audaz como la anterior:

En primer lugar, siguiendo las enseñanzas de Marx y Engels, destruir todo rastro de Max Barry y el culto a su persona en este país. Esta acción supondría un desafío directo a lo que predica la Asamblea Mundial y probablemente nos condenaría. Al destruir el culto a Max Barry me refiero, por supuesto, a la propaganda que ha difundido a través de la Asamblea Mundial. Para los miembros del Partido que quizá no estén familiarizados con Mister Barry, se le ha descrito como un Libertario. Sin embargo, son mentiras destinadas a consolarnos, en realidad es un peón de las máquinas capitalistas. Por lo tanto, eliminando su culto de nuestro país y proscribiendo su propaganda, podemos garantizar que la juventud se mantenga a salvo de los peligros que desechamos tras el gobierno de Rodolfo Vicente y su propio culto a la personalidad.

Se ha decidido que desafiaremos a los esclavistas de la Asamblea Mundial y que, con efecto inmediato, no votaréis ningún asunto hasta que se os diga lo contrario. Todo lo que se apruebe mientras estemos en protesta será desafiado".

¡Camaradas! El 90º Congreso del Partido Comunista de la Patagonia y Dependencias del Sur ha manifestado con una nueva fuerza la inquebrantable unidad de nuestro Partido, su cohesión en torno al Comité Central y su decidida voluntad de cumplir la gran tarea de construir el comunismo. Y la realidad de que presentamos en todas sus repercusiones los problemas primordiales de la solución del culto al individuo ajeno al marxismo, así como el predicamento de la liquidación de sus onerosas ramificaciones, es testimonio de la gran fuerza moral y política de nuestro Partido. Estamos absolutamente seguros de que nuestro Partido, armado con las resoluciones históricas del 90 Congreso, conducirá al pueblo soviético por el camino Marxist a nuevos éxitos, a nuevas victorias. ¡Viva la bandera victoriosa de nuestro Partido!

Comrades! In the Party Central Committee's report at the 90th Party Congress and in a number of speeches by delegates to the Congress, quite a lot has been said about the cult of the world assembly and about its harmful consequences.

Since the formation of the World Assembly, the Central Committee has been hesitant to trust it on any affair brought before it and has actively resisted following any resolution it has attempted to force upon us. In the name of preserving the work of Marx and late Comrade Esteban, we have acted in such matters which we deemed to be necessary to preserve our culture and way of life. The World Assembly has also brought about a cult of personality around Max Barry, which strives to model him with supernatural characteristics, akin to that of a God. It was such ideals which caused us to condemn Max Barry in 2008 at the 74th Party Congress.

Such beliefs and activities, specifically around those beliefs and activities which threaten the ideals of Marxism and hail Max Barry as a God, have been cultivated among nations for many years.

The objective of the present report is not a thorough evaluation of the World Assembly or of Max Barry himself. Such materials have already been written from abroad. The present report concerns the issue that the World Assembly is deeply corrupt and holds the objectives of spreading that corruption and ending Communism on a global scale.

In recent weeks, the corruption of the World Assembly was put on full display before the world as the representative from Wallenberg was removed from office without warning or public reasoning. By doing this, the World Assembly has shown itself to be a force of nepotism and Capitalism, thereby making it a threat to the tenants which we fought for nearly a century ago. Yet these have not been the only actions by the World Assembly which are corrupt, time and again favouritism toward certain proposals has been shown, newer members are refused the same or equal opportunity as more senior members. This occurs whilst the World Assembly hails itself as a place where all may have a voice. But how can all have a voice when some are allowed to be heard more than others? It is hypocrisy.

At present, we are concerned with a question which has immense importance for the Party and nation now and for the future – with how the cult of the person of Max Barry has been gradually growing, the cult which became at a certain specific stage the source of a whole series of exceedingly serious and grave perversions of principles we wish to uphold, of undemocratic principles, of revolutionary legality.

The Party and Nation have two choices before it on this matter, each equally as dangerous yet bold as the last:

Firstly, in following the teachings of Marx and Engels, we destroy all traces of Max Barry and the cult of his person within this Country. This action would stand in direct defiance of what the World Assembly preaches and is likely to have us condemned. In destroying the cult of Max Barry, I refer to, of course, the propaganda he has spread through the World Assembly. For members of Party perhaps unfamiliar with Mister Barry, he has been described as a Libertarian. However, these are lies meant to comfort us, in reality he is a pawn of capitalistic machines. Therefore, by removing his cult from our country and outlawing his propaganda, we can ensure that the youth is kept safe from the dangers which we cast asunder in the aftermath of the rule of Rodolfo Vicente and his own cult of personality.

Secondly, we kowtow to the demands of the World Assembly and remain complacent. This act would likely ensure our security, however it would sacrifice all that we have fought to gain and achieve.

The Communist Party of Patagonia and the Southern Dependencies shall not bow to no man or king. We shall be defiant against the World Assembly, that is the will of the Central Committee. Our actions shall be dangerous, yet all in the name of an honourable cause. The orders being dispatched to our Ambassador to the World Assembly is thus: ”The Central Committee and wider Party have convened and voted on the matters pertaining to the cult of personality around Max Barry and the corruption within the world assembly. It was decided that we shall stand in defiance of the World Assembly's slave owners, effective immediately you are not to vote on any matter until otherwise told. Anything passed whilst we are in protest shall be defied.”

Comrades! The 90th Congress of the Communist Party of Patagonia and the Southern Dependencies has manifested with a new strength the unshakable unity of our Party, its cohesiveness around the Central Committee, and its resolute will to accomplish the great task of building communism. And the reality that we present in all their repercussions the primary problems of resolving the cult of the individual which is alien to Marxism, as well as the predicament of liquidating its onerous ramifications, is testimony of the great moral and political strength of our Party. We are absolutely certain that our Party, armed with the historical resolutions of the 90th Congress, will lead the Soviet people along the Marxist path to new successes, to new victories. Long live the victorious banner of our Party!

Hello everyone. I would like to congratulate all my colleagues who were elected to Member of the Convention, and even those who were not elected, it was a great campaign! I also congratulate all the citizens who voted, who cared about this first step towards Thaecia's future. Congratulations to our Convention Leader, Brototh! May Thaecia walk the path to the future. Hello Residents! The Constitutional Convention is officially starting now.
On Discord, there are three channels in use: #board, #member-vote, #debate. However, all legislation and debates will also be posted on the Regional message board.

The first business that I will be putting up is the restoration of the old Article I and Article II (which is about the Constitution's supremacy and Thaecian citizens rights). These are definitely very uncontroversial so I am going to put these up first, get them out of the way and get everyone into the feel of the Convention. Definitely use this as a chance to write up anything you've got. Also, if you want to add more rights later but it hinges on something else you've got planned- no worries, if that passes, we can come back and amend anything later as we wish.

This is the first Order of business:


FIFTH CONSTITUTION OF THAECIA


Article I - Supremacy and Amendments
  • Section I - This Constitution is the supreme law of Thaecia, and any law or government action inconsistent with the provisions of this Constitution is, to the extent of the inconsistency, of no force and effect.

  • Section II - Amendments to this Constitution may only be passed with a 2/3rds majority in each Chamber of Congress and the approval of the citizenry with a 3/5ths majority vote in a referendum.


Article II - Rights
  • Section I - All Thaecian Citizens are guaranteed the following rights without government interference;

    1. The right to freedom of expression, opinion, and speech, insofar as this right is not exercised in a way that breaches NS rules;

    2. The right to free association; this includes the right to form or join a political group or media organization;

    3. The right to equal protection under the law;

    4. The right to seek legal redress from government actions, including through votes of no confidence and the courts;

    5. The right to stand for all offices elected by the whole citizenry;

    6. The right to vote in elections and referendums unless they became a Citizen during the election or referendum they wish to vote in;

    7. The right to be presumed innocent until proven guilty in a court of law;

    8. The right to due process of law in all interactions with the government of Thaecia;

    9. The right to representation in a court of law;

    10. The right to a free, speedy, and fair trial;

    11. The right to personal privacy;

    12. The right to protection from ex post facto laws, bills of attainder, double jeopardy, and forced testimony against oneself.

  • Section II - The non-inclusion of a right on this list does not preclude its existence.

  • Section III - This Constitution guarantees the rights set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society.

Voting Recommendation: AGAINST

REASONING:
The Thaecian World Assembly Office recommends you vote AGAINST this resolution. This is because while the resolution has the best intentions at heart by being customer focused; this resolution is unrealistic and sets a mandate on non-WA nations. Firstly, the resolution would require flights from non-WA airports to WA nations to comply with this resolution. Secondly, the resolution requires the safety & comfort rating of every single flight to be available in physical form in every single language used within a WA state, which could be hundreds; this creates environmental concerns. Finally, there is concern this could harm the Airline business. Air travel is a vital means of transport, and these regulations could result in airlines going bust due to an increase in costs, or more likely lead to airplane tickets rising, bad for consumers.

Security Council (SC)

Voting Recommendation on: Repeal: “Liberate Realm Of The Whispering Winds”

Voting Recommendation: FOR

REASONING:
The Thaecian World Assembly Office recommends you vote FOR this resolution. This is because the region currently cannot set border controls due to the liberation resolution. The region needs the border control powers to protect the historic region from pirates wanting to raid the sea-based roleplay region.

The Thaecian World Assembly Office

The Thaecian World Assembly Office is the Office responsible for all things World Assembly (WA) related. The Office represents the elected World Assembly Delegate (WAD) and the Vice Delegate (VD) when the WAD is not available.

The WADs key role is to vote on proposed resolutions in the General Assembly and Security Council. They vote on behalf of the Thaecian region as a whole. Their vote often sways how Thaecian World Assembly citizens vote.

While not required, it is precedent that for each vote the WAD will ask for opinions from Thaecians on a resolution in the Thaecian Regional Message Board (RMB) and/or a dedicated World Assembly channel on the Thaecia Discord server. These discussions and opinions can help a WAD decide how to vote on a proposal, and also allows the opportunity for the Thaecian Government and other senior Foreign Affairs officials to have their input should they wish. Once a decision has been made and a vote cast, the WAD publishes a dispatch stating how they voted and why. It is worth noting that this, again, is precedent and not required by the WAD.

In the World Assembly, before a proposal can be put to vote, it requires to reach a quorum. This can be achieved by getting there resolution approved by WADs. WADs often receive telegrams requesting that they approve a proposal, and whether they do or not is completely up to them.

In Thaecia, the WAD holds an executive regional officer role. This is an incredibly important role with major responsibility, as the executive regional officer role means the WAD can dismiss/appoint other regional officers, close the regions borders and updated the World Factbook Entry (WFE). This means the WAD needs to be a trusted person who only exercises the executive powers when it is the wishes of the democratically elected Government and Congress. The WAD can freely update the WFE in order to keep citizens up to date on WA and regional happenings.

Democratized Peoples
Undecided on the overall concept of entrenchment clauses. But if we were to do that I'd suggest something a little more concrete. Perhaps:

Section III - Any proposed amendment which impedes the right of the people to freely and openly choose their government or substantially undermines core judicial rights shall not be submitted to the people for ratification nor shall, if ratified by the people, it assume any force or effect.

It's always good to hear good advice. Thanks for the suggestion, I will change the proposal.

I'm still not particularly sure about the proposal. For one, I think that entrenched clauses as an idea are not poor, but I do not agree that they should be absolute. I think that if there is anything going to be entrenched, it should only be raising the standard for amendment, not prohibiting it at all. I believe that making an amendment that restricts us, whether it be in a way that we consider good or bad, is not beneficial for the region's future. If in the future we want to do something that might contradict an entrenched clause- we might in the future have really good reason, we can't see the future- then it gridlocks the region. This is not a good way in my opinion to set up a long lasting government.
Additionally, it could just be circumvented by amending out the entrenched clause first, and then doing another amendment - sure, this would be a harder process, but why then not just raise the bar for amending the rights section?

Secondly, I believe that the proposal is simply too up to debate. There is not a better way to word it in my opinion. The issue comes in that there could be a multitude of interpretations on what core judicial rights are, or if the rights are being "substantially" undermined, or the same for the right to freely and openly choose government; it is not clear what this means. Additionally, it could lead to a potential future issue where the amendment is passed uncontroversially but months later is suddenly rescinded by a new Court that disagrees with it. In my opinion, this empowers the Court too much and gives them too much power to legislate from the bench based on their personal opinions.

For these reasons, at vote I cannot support the amendment. However, I would be more inclined to the passage of a clause that entrenches only the contents of Article II; this is more sensible in my opinion and makes less future issues.

I understand the related concerns, I modified the proposal:

Section III - Any proposed amendment which impedes the right of the people to freely and openly choose their government or substantially undermines core judicial rights expressed in the Article II of this Constitution shall not be submitted to the people for ratification nor shall, if ratified by the people, assume any force or effect.

This change would simply serve to protect constitutional guarantees from possible amendments that tend to abolish or limit these rights in an extreme way, amendments that serve to improve these rights would be permitted

It must be the duty of the Judiciary to make the Constitution understood; the Legislature legislates, the Executive implements, and the Judiciary judges and interprets. It is not the duty of the Constitution to interpret itself, it is simply to ensure that it can be interpreted, and this is explicit.

In any case, any form of legal specification is good, thanks for the suggestions and opinions. An experienced voice is key, thank you.

Fellas, I do not see a need for there to be a provision within the constitution limiting the right of the legislature to do its job (legislating). Limiting amendments that "impedes the right of the people to freely and openly choose their government" is, frankly, pretty broad. I also cannot find a circumstance within Thaecian history where this has ever been done (limiting freedoms). I cannot find a practical use for this amendment, and do not think it should be supported by the members.

I still fundamentally disagree with the notion that as Taralania has said the legislature is restricted from legislating. There is a serious problem in my opinion that this could be unnecessarily harming us in the future by banning constitutional amendments on a specific section. If there is any change, then it should be done in a fashion that makes it harder to amend a section, never impossible. We have seen in the past and even with this convention being held that sometimes even sections that seem to be the most obvious and necessary end up being flawed or need changing. As such, I don’t think that it’s sensible to prohibit amendments on any specific section.
The proposal should read:

Section III - Any proposed amendment to Article II of the Constitution shall require for passage a 3/4ths majority in each Chamber of Congress and the approval of the citizenry with a 2/3rds majority vote in a referendum.

In my opinion, this achieves the same desired effect of protecting rights while also leaving them up to change later if needed. It’s not possible to see the future. That being said, if some sort of “tyrant” acquired the approval of 3/4ths of Congress and 2/3rds of the general population, he probably wouldn’t be much of a tyrant in the first place, since any change to the rights of the people would be done with their overwhelming agreement.

  • Section III - Any proposed amendment which impedes the right of the people to freely and openly choose their government or substantially undermines core judicial rights expressed in the Article II of this Constitution shall not be submitted to the people for ratification, nor shall, if ratified by the people, assume any force or effect.

I voted Nay as I think the amendment will be too restricting. Amendments require 2/3rds to pass as it is, so I’m theory anything radical or that impedes rights shouldn’t get passed anyway unless it is the will of the people.

The vote will close in 12hrs, considering the majority against it is overwhelming. However, if current 'Nay' votes switch, I may keep it open for longer.

REASONING:
The Thaecian World Assembly Office recommends you vote AGAINST this resolution. This is because while the resolution has the best intentions at heart by being customer focused; this resolution is unrealistic and sets a mandate on non-WA nations. Firstly, the resolution would require flights from non-WA airports to WA nations to comply with this resolution. Secondly, the resolution requires the safety & comfort rating of every single flight to be available in physical form in every single language used within a WA state, which could be hundreds; this creates environmental concerns. Finally, there is concern this could harm the Airline business. Air travel is a vital means of transport, and these regulations could result in airlines going bust due to an increase in costs, or more likely lead to airplane tickets rising, bad for consumers.

The Thaecian World Assembly Office

The Thaecian World Assembly Office is the Office responsible for all things World Assembly (WA) related. The Office represents the elected World Assembly Delegate (WAD) and the Vice Delegate (VD) when the WAD is not available.

The WADs key role is to vote on proposed resolutions in the General Assembly and Security Council. They vote on behalf of the Thaecian region as a whole. Their vote often sways how Thaecian World Assembly citizens vote.

While not required, it is precedent that for each vote the WAD will ask for opinions from Thaecians on a resolution in the Thaecian Regional Message Board (RMB) and/or a dedicated World Assembly channel on the Thaecia Discord server. These discussions and opinions can help a WAD decide how to vote on a proposal, and also allows the opportunity for the Thaecian Government and other senior Foreign Affairs officials to have their input should they wish. Once a decision has been made and a vote cast, the WAD publishes a dispatch stating how they voted and why. It is worth noting that this, again, is precedent and not required by the WAD.

In the World Assembly, before a proposal can be put to vote, it requires to reach a quorum. This can be achieved by getting there resolution approved by WADs. WADs often receive telegrams requesting that they approve a proposal, and whether they do or not is completely up to them.

In Thaecia, the WAD holds an executive regional officer role. This is an incredibly important role with major responsibility, as the executive regional officer role means the WAD can dismiss/appoint other regional officers, close the regions borders and updated the World Factbook Entry (WFE). This means the WAD needs to be a trusted person who only exercises the executive powers when it is the wishes of the democratically elected Government and Congress. The WAD can freely update the WFE in order to keep citizens up to date on WA and regional happenings.

  • Do un-endorse any other nations that have more endorsements than the Delegate-elect

What the outgoing Delegate will do

The outgoing Delegate is legally required to cast their vote on resolutions, and approve proposals, in line with how the Delegate-elect requests.

What the incoming Delegate will do

The incoming Delegate is legally required to endorse all WA nations in Thaecia for the duration of the transition, and send a mass telegram to all WA nations in Thaecia, reminding them to endorse the Delegate-elect.

Amongst the candidates are Bartolo Leon (former Premier), John Norman Pritchard (son of Idwal Pritchard, former premier) and the People's Commissar for State Security, Prudencio López de Lacalle.

Bartolo Leon
Age: 72
Background: Premier from 2002-2014. During his time there was a fear of economic collapse. However, the 1st five year plan of the millennium (2001-2006) saw a major upturn in economic output and the decline in unemployment. Many critics, in the old guard of the Communist Party, feared a move away from Communist ideals and as a result rigged local elections in 2006 to be in favour of more traditional communist party members.

John Norman Pritchard
Age: 64/65
Background: son of the late Premier Idwal Pritchard, who saw the occupation and annexation of the Falklands.
Info: much like his father Ideal, J.N. Pritchard is a believer in the idea of more western style of Government/soft communism. Similarly he has called for modernisation within the Supreme Soviet to make it more diverse politically. However, he is also deeply mistrusted due to several financial scandals and an affair with his mistress.
Info: Bartolo Leon has not been highly involved in the upper echelons of the Communist Party and most consider him a compromise between the Liberal Pritchard and the Conservative López de Lacalle.

Prudencio López de Lacalle
Age: 58
Background: Head of Comisariado del Pueblo para la Seguridad del Estado (the People's Commissariat for State Security).
Info: López de Lacelle is considered on the more conservative side of the Communist Party, a firm believer in the cult of personality forged by the first General Secretary of the Communist Party, Rodolfo Vicente. He is often regarded by the west as dangerous and too sympathetic towards China and Russia, especially in regard to their recent actions toward Taiwan and Ukraine.
