We welcome the challenge of unifying our comrades in the fight against opportunists, imperialists, fascists, and others who would dare threaten both self and friend for their selfish greed and need for power.
We, the people of Wintercrest, do hereby proclaim the People's Republic of Wintercrest and this Constitution, and in doing so we pledge to uphold the left and its socialist ideals and commit to always striving for the better good not just of ourselves, but of comrades all across NationStates.
Forever Forward; let us proceed,
The People’s Republic of Wintercrest was founded, and continues to exist, on the following ideals, which shall be the guiding principles in all endeavours of the government and people of Wintercrest:
The Will of the People is of utmost importance. Their Will shall be executed through:
Regular elections, where every Office of Government shall be re-elected no fewer times than once per calendar year;
The above shall be with the exception to Advisors, and the Chair of Presidential Security;
Democratic representation in all offices, directly or indirectly, at all times;
Transparent governance, where all Members of State shall be honour bound to give all people an insight into how the region is being ran at all times.
The Wellbeing of the people is also paramount to our continuation. It shall be:
looked after, to the best of all ability;
nurtured, by every reasonable means;
expanded, to increasingly higher quality.
All people of all backgrounds shall feel valued and supported within our community and in turn remain respectful to their fellow members. There shall be no tolerance for fascists, racists, Nazi, or any bigoted persons who stand against any group of people for their race, origin, religion, gender, sexual orientation, age, disability, or other identity or status.
All leftists and progressives shall strive to fight all forms of fascism, harassment and hate throughout NationStates. It must be our highest pleasure to not only invade and occupy, but ultimately rid the NationStates community of regions labelling themselves as fascist and Nazi. These same principles must also apply to regions which engage in blatant sexism, homophobia, transphobia, religious intolerance, and other hateful ideologies and practices.
Our region must always be vigilant, both domestically and inter-regionally, in searching for errors in policy and actions and be ready to adapt to meet new problems. Above all, we should always seek to progress and improve our great People’s Republic.
Our region must maintain its right to self determination and always have the flexibility to meet new problems through the will of the people only. Any foreign power attempting to influence or dictate policy to us is not acceptable and should be publicly addressed and condemned.
The People’s Republic of Wintercrest shall guarantee all of the following liberties to the nations and peoples residing within:
Liberty of Equality: The liberty of equal treatment within the region by peers and law, free from harassment or discrimination on the basis of race, origin, religion, gender, sexual orientation, age, disability, or other identity or status;
Liberty of Speech: The liberty to have one's voice heard on any matter publicly as well granting the freedom to express one's views and beliefs in a civil and legal manner without the fear of discrimination or retaliation;
Liberty to Vote: The liberty to vote as one is naturally inclined without coercion in any election or any referendum they are so entitled to vote in;
Liberty to Join: The liberty to join and leave the People’s Republic freely unless duly convicted of a crime in a court of law as well as the liberty to join or create associations, parties, or other groups or clubs;
Liberty to Justice: The liberty to be tried in a fair, impartial, speedy, and public court of law for any action of the government of the People’s Republic that would deprive a nation or person of their liberties as well as the liberty to appeal any decision and not be tried more than once for a single offence.
Wintercrest shall allow citizenship to all who have a nation residing within its borders. This is subject to the following exceptions:
They are deemed to contravene any clause of Article I of the Constitution;
They are or were involved in invasion, treason, sedition, rebellion, or conspiracy against the People’s Republic or one of its allies;
They are the puppet or agent of another nation that is currently banished from the People’s Republic, or which meets the above points:
In the case of a suspected puppet, or other infiltration, any member of the WRAF, the Judicial Assembly, the Advisory, or the State Assembly can decide to temporarily revoke citizenship, unless the suspected member belongs to any of the above;
In the case the suspect is a member of the WRAF, they can also have their citizenship along with their WRAF membership temporarily suspended by the Judicial Assembly, the Advisory, or the State Assembly;
In all other cases, the normal procedure of impeachment/vote of no confidence must be followed;
This is with the Exception where the person in question is deemed to be a threat to the functioning of the office of President or Vice-President of the People's Republic. In this case, the Chair of Presidential Security is allowed to suspend the office of President or Vice-President, any Governor's office, or remove any other official from office as deemed necessary.
All citizens shall be guaranteed the following rights:
The right to view, discuss, and critique the deliberations of the Popular Assembly, non-confidential deliberations and all trials of the Judicial Assembly, and non-confidential deliberations of the State Assembly;
The right to participate respectfully in community events, forums, and other spaces;
The right to challenge any legislative act or any attempted government actions that may contradict the rights established by this Constitution, through voting, voicing concerns, and appeals to the Judicial Assembly;
Citizens in the World Assembly shall be guaranteed the right to vote in any and all elections for government leaders;
Citizens wishing to serve in civil governance or military service shall be required to full fill the following criteria:
Have a World Assembly nation endorsing the Chair of Presidential Security or actively involved with a military approved by the Chair of Presidential security, or the Marshall of Defense;
Join the regional Discord server and make efforts to be actively engaged with the community through chatting and events.
Citizens of the region for at least 1 week shall be guaranteed the following additional rights:
The right to a vote in the Popular Assembly of the People’s Republic of Wintercrest;
The right to stand for election for all elected offices in the People’s Republic, provided they are not serving in any other office on NationStates or at the term limit for the office they wish to stand for election for;
With the exception of the office of President and Vice-President, for which at least three weeks of citizenship shall be required;
If they hold another office on NationStates for another region, they must be approved by the current Chair of Presidential Security, Chief Justice, or the current President in order to run for any office.
The right to utilize their World Assembly nation in any anti-fascist military operation or other military operation in service of Wintercrest as approved by the Governor of Defense or the Chair of Presidential Security;
A citizen may only be denied these rights for any period of time by a simple majority vote in the Judicial Assembly of the People's Republic unless the citizen holds an elected office, in which case they must be removed from that office first according to the relevant procedures before they can be expelled.
The Chair of Presidential Security shall serve as:
The protector of the office of the head of state, currently the President;
World Assembly Delegate;
In case of the region's Governor's demise, they shall serve as the first successor;
Commander of military activities within or on behalf of the People’s Republic, together with the Marshall of Defense;
The only member of government allowed to refuse the authority of the President.
The Chair of Presidential Security shall serve an indefinite term and not be subject to term limit while they hold the office of Chair of Presidential Security;
The Chair of Presidential Security shall not serve in any other position in government in or outside of Wintercrest:
Especially not the office of President, Vice-President, or a Justice;
Except in bodies in interregional organizations which require the presence of the head of state;
Where in the case of the above, the Chair shall be present if there is a concern for the safety of the President, or where the Chair may need to act in the President's stead with urgency.
If the Chair of Presidential Security resigns, ceases to exist, is removed, or otherwise vacates or abandons the office, a replacement shall be selected by the following process:
The State Assembly shall identify no fewer than two and no more than five candidates, who have a WA nation in Wintercrest and have resided here for at least 3 weeks, and submit a recommendation for their ascension to the office of Chair of Presidential Security to the Popular Assembly;
The Popular Assembly shall select from the candidates put forth by the State Assembly one nominee and approve this nominee for vote by a simple majority vote;
The nominee approved by the Popular Assembly shall go to a popular referendum all citizens with the right to vote and must receive a three-quarters majority of non-abstaining votes in favour, a majority of cast votes not in abstention, and at least five valid votes to result in the approval of the nominee as Chair of Presidential Security.
The Chair of Presidential Security may be removed from office by the following process:
A motion of no confidence including the reasons cited for removal from office shall be passed by a three-quarters majority in any of the Assemblies of the Republic and seconded by a simple majority in another Assembly of the Republic;
That motion of no confidence shall go to a popular referendum all citizens with the right to vote and must receive a three-quarters majority of non-abstaining votes in favour, a majority of cast votes not in abstention, and at least five valid votes to result in removal;
If the motion of no confidence fails, then the Chair of Presidential Security may not be subject to removal from office for the same reasons from the same Assembly for one calendar year, unless authorized by the President or Chief Justice of the People’s Republic.
If the Chair of Presidential Security removes any person involved in the vote of no confidence procedure against the chair from any office or from the region, they will still be allowed to finish the procedure before being permanently removed, with all other rights and powers stripped until the procedure is finished, and their office reinstated if the Chair is removed from office.
The Executive branch will be made of the President, a Vice President, the Governors of the Districts, and those within the districts:
The President is the manager of the Governors, and the Vice President is their assistant, who has the powers of the President unless specified otherwise;
The Governors are the manager of their districts, and, if authorized, members of the districts may temporarily have the powers of the governor unless otherwise specified;
The President may use the powers of the Governors unless otherwise specified, and must do so in case of a District not being assigned one;
The Governors may appoint volunteers to the districts to assist them in their tasks;
The State Assembly has the power to make and abolish districts, using laws;
Should a situation arise where there is no Marshall of Defense, the Chair of Presidential Security shall hold supreme power over the WRAF until this position is filled once more;
The President may create informal Districts and appoint them Informal Governors, who will not have the powers of a Governor until approval from the Popular Assembly, unless otherwise specified.
The Executive Branch has the power to make policies, and the duty to enforce policies, laws, orders, and acts.
Governors have the power to declare or dissolve policies pertaining to their district only;
Policies are not legally binding to other branches of government, and guide decisions rather then prevent them;
Policies cannot contradict the law, and should be reviewed by the Judicial Assembly, who should be informed by the Vice President or the President;
Members of the executive branch who are not volunteers should be given appropriate powers on NationStates and Discord to act as moderators and perform their duties;
the Executive Branch is obligated to enforce these. Failure to enforce the above is negligence, perfidy, or treason.
The Executive Branch has the power to participate in legislation:
The President may veto legislation, in which case it must receive a 2/3rd majority to pass. The Vice President cannot do this.
The Vice President or President can ask the Judicial Assembly for an order of non-prohibente or non-caecum, if they feel the legislation either overly interferes with the executive branches duties, or if they feel the law is far to up to interpretation.
The Judicial Assembly may grant orders of non prohibente and non caecum, both preventing a law from being legally binding. The former under the justification that it it overly limits the State Assembly, or is overly demanding of the State Assembly, and the latter that it removes too much power from the State Assembly, in particular their knowledge of other branches' actions.
The President shall serve as the head of State, and shall only be subject to the authority of:
The People, through impeachment, vote of no confidence, or other such means of removal;
The Chair of Presidential Security, who can at any time suspend or refuse the office of President and call a new Presidential election.
The President will be elected by a popular election of the legislative branch every four months, or if the position is vacant or abandoned:
Elections will start on the first of January, May, and September;
All nations interested in serving should nominate themselves before the election starts to be a candidate;
No nation may self-nominate if they have been elected to this position three times in a row. This shall serve as the effective term limit:
They can still be nominated by at least five people in the Popular Assembly, a majority vote in the Judicial Assembly, by an Advisor, or by the Chair of Presidential Security;
In this manner they may sit only up to another 6 terms, for a total of 9 terms, before being permanently barred from the office.
Whenever a nation is re-elected to this position, they also require an approval from an Advisor, upon passing the popular vote;
If they were nominated for the position by an Advisor, a different Advisor shall be required to approve them;
If there is no Advisor available to either approve or refuse to approve them, they shall be approved by the Chair of Presidential Security instead;
If the Advisory refuses or has concerns about approving the President-elect, a vote shall be held in the Judicial Assembly instead;
If they vote against the President, new elections shall be held, with that candidate barred from running;
If they vote for the President, the Chief Justice shall approve them to the office instead.
Candidates should announce a Vice President that would be elected if they won the vote;
This vote should last exactly three days;
if the position of President is vacant, the Vice President or a Governor may announce their intent to succeed them. the Advisory will decide who succeeds the President of those eligible, with the Vice President being given succession priority, unless specified otherwise.
The position of President shall be considered vacant if some event, e.g.. Treason, Betrayal, Real Life event, Breach of Constitution, or Vote of No Confidence, or otherwise, removes them from office; and it shall be considered abandoned if the President fails to show any activity at all, on NationStates or Discord, for 7 consecutive days, for no given prior reason, and every reasonable attempt has been made to establish contact:
Vote of No Confidence: if they desire, any President, Vice President, Chair of any Assembly, the Chair of Presidential Security, at least two members of any Assembly, any member of the Advisory, or five citizens together, may petition for any elected official or the Chair of Presidential Security to be removed from power, including the President. This shall then be voted upon by either the Popular Assembly or Judicial Assembly, and then, or in the event neither of those are available, a popular vote, where a majority of non-abstaining votes shall be required to remove the President.
Additionally, the Chair of Presidential Security may remove the President from office at any time permanently or temporarily until the Judicial Assembly votes for the President to be reinstated.
If either of the above are attempted and the official in question is not removed from or reinstated to their office, they shall be immune to being tried again by the same people, in the same manner and for the same offences, for the remainder of their term or one calendar year, whichever expires first.
If there is no Vice President, there should be an election for the position as if it was the office of the President, where possible.
The Legislative Branch will comprised of the Chair of the Popular Assembly and all citizens endorsing the Chair of Presidential Security:
A nation with a valid World Assembly exemption/waiver, approved by the Chief Justice and Marshall of Defense may also make up the membership of the Popular Assembly
Citizens must reside in the region for at least one week in order to vote in the Popular Assembly.
The Legislative Branch has the power to legislate: 'pass, repeal, and approve laws, and nominate, elect, remove, and confirm members of the government'.
This includes all members of government, as defined in Article I, with the exception of the Chair of Presidential Security;
Laws must be signed by the President, unless they have chosen to veto the law, in which case it shall require a 2/3ds majority to pass in accordance with Article V;
Any law passed with a Presidential veto shall be signed into law by the Chair of the Popular Assembly.
The Chair of the Popular Assembly should be elected in a popular election every four months or if their post is vacant.
the Chair should be elected in the same ways as the President, with the exception that the elections should occur on the fifteenth.
The Chair of the Popular Assembly shall be responsible for introducing bills to the Popular Assembly;
They shall be responsible for the organisation and smooth operation of any elections, in coordination with the President and the Advisory;
The Chair shall be the tie breaking vote in the event of a tie, unless otherwise decided by the Advisory;
They can be removed by a vote of no confidence in the same way as the President.
The Popular Assembly shall serve as the exception to the limitation of holding multiple offices on the following individuals:
The President and Vice-President shall be allowed a vote in the Popular Assembly, being a citizen, but cannot take up any office within it;
Similarly, the Chair of Presidential Security and the Justices may vote in the Popular Assembly, as long as they are citizens, but cannot hold any office.
If the President uses their Veto for a law, they are no longer allowed to also vote on it, as it is then considered to be voted on without the President.
The Judicial Assembly will be made of three Justices, one being the Chief Justice:
These Justices cannot have their position revoked within one week of taking office;
The Chief Justice shall be chosen by consensus among the other Justices, and remain the Chief Justice for the duration of their term as Justice;
The Chief Justice shall be responsible for introducing matters of concern to the Judicial Assembly;
The Justices can be removed via a vote of no confidence, unless as specified in clause a.
The Judicial Assembly has the power to suspend or strike down laws and policies, and the task of ordering, and impeaching government members:
All votes to strike down a law or decisions to impeach must be approved by at least two Justices;
Impeachment of Government Officials shall only be used where a vote of no confidence is deemed too slow;
Any Official currently impeached shall temporarily have their powers revoked until a vote of no confidence has been resolved, or they have been permanently expelled from their position by any other reason.
The Chair of Presidential Security, Advisors, or other Justices may not be impeached.
The Judicial Assembly has authority to invoke emergency powers:
Emergency powers shall be used only in case of a breakdown of normal government function:
A breakdown of government function shall be defined as any situation where the constitution cannot be followed.
Emergency powers must be used to restore normal operation of the government, and to deal with immediate threats, and shall be ceded once this has been achieved;
Emergency powers may last for a maximum of one month, and may not be initiated again afterwards for another month;
Emergency powers may not amend this Constitution, only reinterpret its clauses;
The decision to invoke emergency powers must involve all three Justices, and be unanimous, where all three Justices independently solemnly swear that this is vital for the survival of our region.
Justices are elected every six months, or when their position is vacant:
These elections shall occur in the last week of January and June;
As stated above, they cannot have their position revoked within one week of taking office;
These elections shall take place in the Popular Assembly, from Popular Assembly members.
Only nations who have been in Wintercrest for at least 3 weeks and who's main region of residence is Wintercrest may be elected to this position;
Justices must be approved by the current President before taking office;
The Justices should adhere to the Wintercrest Iustitia Instructiones Law, which may be modified by the Popular Assembly but not abolished.
Justices cannot hold any other offices in Wintercrest, including, but not limited to, President, Vice-President, or Chair of Presidential Security, unless otherwise specified.
The Advisory will be made of advisors, important figures of Wintercrest who are no longer willing or able to participate fully in politics, and who have been nominated to this position of special honour.
Advisors can be anyone historically involved and important in the region, such as:
Ex-Presidents, now subject to term limits;
Founders of the People's Republic of Wintercrest, and members of the Winter Family;
People diligently serving for a long time in a post, which no longer exists, or in which they were eventually honourably replaced;
Anyone of cultural or historical importance, who may due to circumstances no longer have as much time or effort to dedicate to the region;
Any person deemed important to the region's culture, history, environment, or otherwise.
Advisors shall not be required to full fill any duty, implied or not, unless they so desire;
Any advisor may resign from their position at any time;
An advisor shall be appointed to that position with the agreement of the President, the Chief Justice, and that of all other advisors.
The advisory has the power to see all confidential conversations on the discord, and provide advice to any government official:
This does not force them to be a part of any private conversation outside the official Discord server;
They may be asked, or choose to not intervene or participate in any discussion or channel, as they desire;
They may or may not be a part of any other government role, provided it does not specify it has to be the only role that person has;
They may choose to be a part of any moderation team or other organisation of similar consequence set up at any time.
Advisors have limited legal immunity:
They cannot be removed from their position other than through a vote of no confidence:
Vote of No Confidence: if they desire, any President, Vice President, Chair of any Assembly, the Chair of Presidential Security, at least two members of any Assembly, any other member of the Advisory, or five citizens together, may petition for any elected official or the Chair of Presidential Security to be removed from power, including any member of the Advisory. This shall then be voted upon by either the Popular Assembly or Judicial Assembly, and then, or in the event neither of those are available, a popular vote, where a majority of non-abstaining votes shall be required to remove the member of the Advisory.
They cannot be impeached;
They cannot be required by any law to meet a certain standard of activity, and shall be by default immune to any law that would otherwise state such;
They are not required to meet citizen requirements in order to remain an official citizen of Wintercrest.
Advisors can take on temporary powers of positions, given the position is empty, and it is needed with haste:
This can only be done if the normal method of filling the position is too slow, or unable to occur;
This should be a temporary measure;
This should be agreed upon by the Chief Justice or the President where possible;
This is not mandatory, or required of their role.
The Advisory shall work together with the Chair of the Popular Assembly to oversee popular elections to ensure fairness:
A popular election shall mean every Citizen of Wintercrest shall have a vote;
Valid votes in a popular election are FOR any candidate or proposal, or abstain;
To win, a candidate must have over half the votes, unless otherwise specified;
If no candidate wins, the advisory decides between the two with the highest votes, unless otherwise specified;
If the advisory thinks there has been foul play, they can temporarily freeze the results while they and the Judicial Assembly investigate, for up to one month;
This shall be done in emergency situations only.
The mission of the Armed Forces of Wintercrest is:
To defend the interests of the working people;
To assist and create socialist revolutions around the world;
And to safeguard and protect the freedom, independence, and peace of the region from foreign aggression.
The offensive division of the Armed Forces shall be known as Wintercrest Republican Armed Forces (WRAF).
Its tasks will include:
The training of competent game players;
Who will take part in:
Both raiding and defending;
Working with other leftist regions to attack fascists when opportunities arise;
And a force which can be summoned at reasonable notice for integral government operations and emergencies.
The Wintercrest Republican Armed Forces or WRAF shall be led by the Marshall of Defense:
The Marshall can be any citizen with a WA nation free and ready to serve as a tactical unit;
The Marshall should be a citizen for a period of greater than a month OR have prior experience in Raiding and Defending gameplay;
The Marshall of Defense shall be appointed by the President and confirmed by the Judicial Assembly;
The Marshall of Defense's appointment shall be reviewed and confirmed again at least once every calendar year since the original appointment;
The President may initiate the replacement procedure at any time, but a replacement must be approved by the Judicial Assembly before becoming final;
The Marshall has full command over all military operations under normal circumstances, but shares authority with the Chair of Presidential Security;
If there is a Marshall, the Chair of Presidential Security shall only interfere in the military where it is deemed unsafe, too slow, or overly cumbersome for the Marshall to do so;
The Chair of Presidential Security can remove the Marshall from command at any time, without appointing a replacement;
If this happens, the President should immediately start the replacement procedure;
The Chair of Presidential Security shall hold supreme military command at all times during the absence of a Marshall, until such a time as a new Marshall can be appointed.
The WRAF shall consist of an air force, an infantry force, and a naval force:
The Air Force units shall be led by an Air Force Commander;
The Infantry Force shall be led by an Infantry Commander;
The Naval Force shall be led by a Naval Commander;
The three commanders are appointed by the Marshall, who themselves can serve as one, two, or all of these;
These appointments must be confirmed by the President.
Citizens may sign up to the WRAF by means of any sign-up procedure established by the Marshall;
Soldiers in the WRAF may resign at any time of peace;
If a soldier agrees to participate in a military mission, they may not resign until the mission is complete except with permission of the Marshall.
Failure to participate in, or attempting to hinder a mission may be determined to be Treason to the Republic by the Marshall, with final judgement passed in the Judicial Assembly;
The internal defense of the region shall be known as the Boogie Oogie Socialist Squad (BOSS):
They will be the first line of ideological and political defense, the first to enact the directives and orders of the Chair, President or Marshall.
They will be tasked with:
Ensuring the continued security of the appointed WA Delegate through endorsements;
Moderation of official Wintercrest communications such as the Regional Message Board and any official chat rooms that the region runs;
Endorsing any official endorsees and promoting cross-endorsing;
Being the ideological vanguard force of the region through promotion of information, reporting of counter-revolutionary activities;
And other tasks found to be substantially beneficial to the wellbeing of Wintercrest and its people.
The Boogie Oogie Socialist Squad shall be headed by a council of nations, who shall be considered the head administration for the region;
This council will be known as the Joint Chiefs of Staff and will comprise of the following:
The Revolutionary Guard, who shall be considered the head of the Boogie Oogie Socialist Squad:
The Revolutionary Guard shall be appointed by the Marshall of Defense and approved by the Judicial Assembly, and confirmed at least once a year.
The Marshall of Defense;
The President and Vice President of the State Assembly;
The Chief Justice of the Judicial Assembly;
The Chair of Popular Assembly;
The Chair of Presidential Security.
The Boogie Oogie Socialist Squad may compose of trusted citizens who either:
Have previous moderation experience;
Resided in Wintercrest for a period of more than 3 months;
Or is otherwise qualified to carry out the obligations listed in Article VIII, Section 8;
And are trusted (I.E. appointed) by a Chief of Staff and confirmed by another.
All members of the Boogie Oogie Socialist Squad must actively have a World Assembly nation either in Wintercrest or on standby, ready to move at a moment's notice;
Members of the Boogie Oogie Socialist Squad may not serve in another region’s government:
Any exceptions to this must be agreed upon by 4 of the 6 Joint Chiefs of Staff.
Citizens who are members of the Boogie Oogie Socialist Squad may be have their position revoked for violating the following:
They are deemed to contravene any clause of Article I of the Constitution;
They are or were involved in invasion, treason, sedition, rebellion, or conspiracy against the People’s Republic or one of its allies;
They are the puppet or agent of another nation that is currently banished from the People’s Republic, or which meets the above points.
In the case of the above, the Revolutionary Guardian shall revoke and seize their status pending official trial via the Judicial Assembly.
The Fourth Constitution of People’s Republic of Wintercrest shall serve as the highest legal document of Wintercrest and shall take precedence over all other pieces of legislation and prior Constitutions of Wintercrest;
Any Section of any Article shall be interpreted according to the framer's original intent, and any loophole found in this or any further legal document shall not be usable for any purpose other than the original intentions of the People who voted and ratified the legislation;
Any Amendment or superseding Constitution shall go through three rounds of voting, as follows:
First, any Assembly of the Republic must vote to propose the amendment to the constitution, called the Proposal Vote. This vote shall require a simple majority to pass, and allows the constitution to be presented for the Acceptal Vote.
If the Proposal Vote passes, any other Assembly of the Republic shall be tasked with holding an Acceptal Vote. This vote shall last at least seven days, and also requires a simple majority to pass. This vote allows the Amendment to go to Popular Referendum.
If the Acceptal Vote passes, a Popular Referendum for the people to assent to the Amendment shall be held, involving all citizens.
A Referendum of the people to assent to an amendment to this Constitution or superseding Constitution must receive a three-quarters majority of non-abstaining votes in favour, a majority of cast votes not in abstention, and at least five valid votes to be adopted.
