The Constitution of Liberlandia
Liberlandia, a region founded on the twenty-seventh of November in the year of our lord(s) 2023 by Kaiser Emeritus Gotawa, and first populated by the nations Hemogard, Gretarian, Thercus, and North Admin Kylood, was founded under the tenets of freedom of political thought. Liberlandia was and continues to be a refuge for open-minded debate, under the crucial pillar of freedom of expression enshrined in this very Constitution.
The Liberlandian Constitution, written and designed to safeguard the sovereignty of individual member states, establish a cohesive set of regional laws and mandates, enhance the region's international standing, and foster political unity, while protecting against future coups or foreign invasions, is hereby established before the governments of all member states and in view of foreign observers.
Section I: The title of President is henceforth established, and said person granted principal authority of, and within, the region.
Section II: The President is permanently assigned and may be replaced only after a willing abdication of the former officeholder.
Section III: The President holds supreme authority over appearance and the Regional Front Office (World Factbook Entry).
Section IV: The President is granted executive power; with Cabinet approval, the President may enact changes, including embassy management and decisions pertaining to Liberlandia’s foreign affairs.
Section V: The President represents the region in diplomatic matters as the principal face of Liberlandia.
Section VI: The President may, with unanimous Cabinet approval, institute a regional password.
Section VII: The President may, with unanimous Cabinet approval, initiate a transition to/from Frontier status.
Section VIII: With unanimous approval from the Cabinet and Founding Fathers, the President may dissolve the region.
Section IX: The President may remove any member state, though this action is perennially subject to veto by a Cabinet member; if vetoed, the Cabinet votes on the matter.
Section X: The President may propose constitutional amendments and enact them with the Cabinet and Founding Fathers’ approval.
Section I: The Prime Minister is the second-highest government authority, responsible for appointing a Cabinet.
Section II: The Prime Minister’s term is temporary, with no indefinite office holding allowed.
Section III: Ministerial elections regarding this regional governmental position occur every six (6) months from the taking of office until the start of the next election.
Section IV: The Prime Minister may enact foreign policy changes only with Cabinet approval.
Section V: The President may ban the Prime Minister in response to serious violations of Liberlandian law, always counting with a rapidly ensuing retrospective Cabinet discussion.
Section VI: The Prime Minister, with Presidential approval, may initiate referendums on relevant regional policies, to be voted upon by Liberlandian Sovereign States.
Section VII: Liberlandian Sovereign States may only run for this position if they have resided within the region for longer than a duration of six (6) calendar months, and have been endorsing the WA Delegate for the same amount of time.
Section I: The World Assembly (WA) Delegate is granted authority in international WA affairs, representing Liberlandia in the WA.
Section II: To safeguard the region, the WA Delegate is to receive a Regional Office (RO) position and Minister of WA Affairs title; with the initial role of WA Delegate remaining non-executive.
Section III: The Minister of WA Affairs is elected democratically and operates independently from the Prime Minister, despite still being considered a member of their Cabinet.
Section IV: In the eventuality of a tie in a Cabinet vote, the Minister of WA Affairs has the tie-breaking vote and role, and is expected to settle intra-governmental differences by using this power.
Section V: The Minister’s vote on WA resolutions represents Liberlandia’s official stance on the issues at hand.
Section VI: The Minister of WA Affairs issues declarations on Liberlandia’s positions on WA resolutions, explaining the rationale behind the region’s stance.
Section VII: If any Cabinet member finds themselves disagreeing with the Minister’s vote, holding it to be misrepresentative of Liberlandia’s core values, a Cabinet vote may be convoked.
Section VIII: If a Liberlandian Sovereign States endorsing the WA Delegate for over a month contests the Minister’s vote, the Prime Minister may initiate a short-term vote lasting less than twenty-four (24) hours. A majority of two-thirds (⅔) disapproving of the Minister of WA Affairs’ choice institutes a stance change.
Section IX: In elections, non-endorsing Founding Fathers may still vote.
Section I: The Watch is hereby established as a Governmental apparatus, tasked with carrying out day-to-day decisions regarding the regulation of the region’s many sites for debates. They are to carry out investigations on potential breaches of rules of conduct and ensure the overall safety, hospitality, and good health of the region and its forums.
Section II: The Watch shall be under the supervision of the President and Liberlandia’s Founding Fathers. The Watch may only kick/ban Liberlandian Sovereign States with the approval of either the President or two Founding Fathers. Alternatively, The Watch may ‘mute’ the offender as they see fit, depending on the gravity of the acts in question.
Section III: The Founding Fathers and the President are tasked with appointing new members of The Watch when they deem it appropriate.
Section IV: Thercus, hereby declared leader of The Watch, shall retain a position within Liberlandia’s Cabinet, but will not have any power on NationStates beyond the ability to vote in Cabinet decisions.
Section I: On certain specific occasions, a Liberlandian Sovereign State who has proved to be of exceptional help to the region, and has displayed an uncommonly proactive character, should they wish it, can become a permanent member of the regional Cabinet.
Section II: This Cabinet position, named accordingly to each member’s desire, follows the same rules as the Prime Minister, with the President being able to impose a ban in response to serious violations of Liberlandian law, always counting with a rapidly ensuing retrospective Cabinet discussion.
Section III: The founder of the region, and its Kaiser for the duration of one-hundred and sixteen (116) days, Gotawa, is a permanent member of the Cabinet, and his position is that of Kaiser Emeritus.
Section IV: The incumbent President, and retired WA Delegate, Hemogard, shall retain a position of Minister of Environment to ensure easiness of day-to-day administrative processes.
Section V: The other retired WA Delegate, incumbent Prime Minister, notable face, and leader of the region’s early days, Gretarian is hereby named another permanent member of the Cabinet, and will hold the title of Chairman.
Section I: Every member state of Liberlandia is hereby declared as having rights to practice their faith and religion, free speech, self-determination, and peaceful assembly. With the region’s core tenets lying in the freedom of political expression, these rights shall not be infringed upon in any way.
Section II: Nations of foreign regions, seeking refuge from oppressive policies, or searching for a safe place with freedom of thought and expression to discuss a variety of topics shall be granted the right to fully integrate in Liberlandia as member states.
Section III: Nurturing the right to self determination, every active and committed member state of Liberlandia has the right to run for government office. Liberlandian Sovereign States endorsing the WA Delegate, with exceptions, may participate in all regional democratic voting procedures. Liberlandian Sovereign States who do not endorse the WA Delegate shall be only allowed to vote in regional elections and certain polls.
Section IV: In the case of a nation having earned a particularly ill reputation, the President and the Founding Fathers may decide to deny said nation the right to become a Liberlandian Sovereign State.
Section V: All Liberlandian Sovereign States are hereby required to adhere to the rules imposed on the region by this Constitution, the regional Rules of Conduct for Debate, and any other legislation voted on by the Cabinet.
Section VI: Member states proven to have committed violation of rules imposed on the region shall face consequences according to the severity of their actions.
Section I: The Cabinet in its authority shall, if deemed necessary, propose amendments to this Constitution.
Section II: If the amendment is approved by the President and the Founding Fathers, following a pluralistic election, the amendment shall be integrated as a standard section of the constitution and applied to Liberlandian Sovereign States thereafter.
Section III: When the amendment has been implemented, all Liberlandian Sovereign States shall be notified via either, but not limited to: a dispatch communicating the relevant changes, an announcement on the regional Discord server, and/or a communiqué distributed in the form of a NationStates Telegram.
Section IV: Idem for the Rules of Conduct for Debate, all the above legislation applies.
Section V: For the here mentioned list of Unelected Cabinet Members, the above rules do not apply, as this change to the constitution is to be held as an administrative formality, and does not affect Liberlandian Sovereign States directly.
Section VI: Aesthetic amendments to the constitution do not require Cabinet approval and can be done at any time.
