Constitution of the Kingdom of Lunar Sand


Preamble
We, the people of the Kingdom of Lunar Sand, united by our shared history, culture, and commitment to justice and equality, do hereby establish this Constitution to secure peace, promote the common welfare, and ensure the rights and dignity of all citizens. In recognition of our past struggles and in the pursuit of a prosperous and just future, we declare this Constitution to guide our nation under the rule of law.

Article I: Sovereignty and Territory

1.Sovereignty of the Nation
The Kingdom of Lunar Sand is an independent and sovereign state. No external power shall have dominion over its government or people.

2.Territorial Integrity
The territory of the Kingdom of Lunar Sand shall encompass all lands, airspace, and waters historically and lawfully associated with it, as defined by its internationally recognized borders. Any modification of the national borders must be ratified by a national referendum.

Article II: The Monarchy

1. The Monarch
The Kingdom of Lunar Sand is a constitutional monarchy. The Monarch shall be the Head of State and symbol of national unity, representing the Kingdom domestically and internationally.

2.Succession
The monarchy shall be hereditary, following the direct lineage of the ruling family. In the event of no direct heir, a national council shall convene to determine a new monarch in accordance with the laws of succession.

3. Powers of the Monarch
a. The Monarch shall have the power to:
- Sign bills into law.
- Represent the Kingdom in international diplomacy.
- Appoint the Prime Minister based on parliamentary elections.
- Grant pardons in accordance with the law.
b. The Monarch’s powers shall be exercised in accordance with the laws of the land and under the advice of the Prime Minister and Parliament.

4. Oath of the Monarch
Upon accession, the Monarch shall swear an oath to uphold the Constitution, protect the sovereignty of Lunar Sand, and serve the people faithfully.

Article 1 = separation of powers
1. Separation of Powers

The government of Lunar Sand shall be composed of three distinct branches: the Executive, the Legislative, and the Judicial, which shall function independently but cooperatively for the governance of the Kingdom.

Section 1: The Executive Branch

1. The Prime Minister
The Prime Minister shall be the Head of Government and is responsible for the day-to-day administration of the Kingdom.

2. Appointment
The Prime Minister shall be appointed by the Monarch, following the outcome of parliamentary elections, with the leader of the majority party or coalition being the first candidate for appointment.

3.Duties and Powers
a. The Prime Minister shall:
- Form a government and appoint ministers.
- Propose legislation to Parliament.
- Ensure the execution of laws.
- Represent the Kingdom in matters of domestic and international policy, subject to the approval of Parliament.

4. Council of Ministers
The Prime Minister shall appoint a Council of Ministers, responsible for various governmental departments. Each Minister shall be accountable to Parliament for their department's conduct.

1. The Parliament
The legislative power of the Kingdom of Lunar Sand shall be vested in a unicameral Parliament, elected by the people.

2. Representation and Elections
a. Members of Parliament (MPs) shall be elected by universal suffrage through free and fair elections every five years.
b. Parliament shall represent the will of the people and legislate in their best interests.

3.Duties of Parliament
Parliament shall have the power to:
- Make and amend laws.

- Ratify international treaties.
- Hold the Executive accountable through oversight and inquiry.

4. Legislative Process
a. Bills may be introduced
by either the Prime Minister or MPs.
b. A bill must be passed by a majority vote in Parliament and signed by the Monarch to become law.

1.The Judiciary
The judicial power of the Kingdom of Lunar Sand shall be vested in an independent system of courts. The highest court shall be the Supreme Court, whose decisions are final.

2. Judicial Independence
The Judiciary shall operate independently of the Executive and Legislative branches and shall interpret and apply the laws of the Kingdom impartially.

3. Rights of Citizens
Every citizen shall have the right to a fair trial, representation by counsel, and access to the courts in matters concerning their rights and obligations.

4. Supreme Court
a. The Supreme Court shall have the authority to review the constitutionality of laws.
b. Judges shall be appointed based on merit, and their independence shall be safeguarded.

Article IV: Fundamental Rights and Freedoms

1.Equality Before the Law
All citizens of Lunar Sand are equal before the law, regardless of race, religion, gender, or ethnicity. Discrimination in any form is prohibited.

2.Freedom of Expression
Every citizen has the right to freedom of speech, press, and expression, subject to limitations necessary to maintain public order and respect the rights of others.

3.Freedom of Assembly and Association
Citizens have the right to peacefully assemble, form associations, and participate in political and civil organizations.

4.Right to Education
Every citizen has the right to free and compulsory primary and secondary education. Higher education shall be accessible to all based on merit.

5. Right to Health
The government shall ensure access to healthcare for all citizens, promoting the physical and mental well-being of the people.

6. Right to Privacy
Citizens have the right to privacy in their homes, communications, and personal data. Unlawful searches, seizures, and surveillance are prohibited.

1. Supremacy of the Constitution
This Constitution is the supreme law of the Kingdom of Lunar Sand. Any law, decree, or act of government that contradicts the provisions of this Constitution shall be null and void.

2. Oath of Allegiance
All government officials, including the Monarch, Prime Minister, Ministers, MPs, and Judges, must swear an oath to uphold the Constitution and act in the best interests of the nation and its people.

3.Transitional Provisions
All existing laws shall remain in effect until repealed or amended to align with this Constitution.
