UCN BAR ASSOCIATION ACT

SECTION1 1: MISSION & PURPOSE
1.1 The Bar Association of the Union of Christian Nations (hereinafter, the UCN Bar Association) is hereby created with the mission of giving institutional hierarchy to the justice service of the UCN, strengthening the judiciary and guaranteeing the professionalism and legal knowledge of its members.
1.2 The purpose of the UCN Bar Association will be to serve as the only regional institution in which those UCN residents who wish to practice as lawyers must register.


SECTION 2: LAWYERS OF THE UCN. REQUIREMENTS
2.1. Any resident or group of residents of the UCN that acts as a party before the tribunals or the Supreme Court may request the assistance of a lawyer registered with the UCN Bar Association.

The provisions of the preceding paragraph do not prohibit the possibility of representing oneself. However, this right must be exercised at the beginning of any judicial case, and the assistance of a lawyer cannot be requested during the course of the judicial process.

2.2 Any UCN resident may request registration with the UCN Bar Association through a formal request to the regional Chief Justice, which will be analyzed by the members of the Supreme Court.
2.3 The following requirements must be met to approve the request mentioned in the preceding article:
2.3.1. The applicant must have a minimum residence of 5 days in the region, which must be fulfilled at the time of application.
2.3.2. The applicant must not be a puppet of another UCN nation.
2.3.3. The applicant must not be found serving sentences for high crimes, indictable offenses or misdemeanors under the Criminal Code Act 2020.
2.4. Once the application for registration is approved, the applicant will be granted a "registered candidate" status. To obtain definitive registration, the applicant must take and pass the "Introduction to Law" course at the Nationstates School of Law.
2.5. The Chief Justice, in agreement with the Associate Judges of the Supreme Court, may establish other courses in regional law in the future and establish their approval as an additional requirement to obtain definitive registration.


SECTION 3: OBLIGATIONS & RIGHTS
3.1. Lawyers must:
3.1.1. Faithfully observe the UCN Constitution and the legislation that is enacted as a consequence.
3.1.2. Provide professional assistance in the service of justice in compliance with the duties of loyalty, probity and procedural good faith.
3.1.3. Faithfully observe lawyer/client privilege, unless authorized by the interested party.
3.1.4. Do not abandon the trials that their clients entrust them.
3.2. Without prejudice to the other rights granted to them by law, it is the power of lawyers in the exercise of their profession to request from public officers information concerning the matters that have been entrusted to them. Strictly private information declared reserved by legal provision is excepted from this provision. In these cases, the lawyer must request the information through the judge of the case.


SECTION 4: OF THE DISCIPLINARY AND ADMINISTRATIVE POWERS OF THE UCN BAR ASSOCIATION. THE DISCIPLINARY BOARD
4.1. It is the exclusive power of the UCN Bar Association to oversee the correct exercise of the profession of lawyer. To this end, it will exercise disciplinary and administrative power regardless of the civil, criminal or administrative responsibility that may be attributed to those enrolled.
4.2. The UCN Bar Association will be managed by a President and a Vice President, who will be in charge of the ordinary affairs of the institution, among which are:
4.2.1. Keep the registry of lawyers updated, specifying whether the registration is provisional or definitive, in accordance with the provisions of Section 2.4.
4.2.2. Notify the Disciplinary Board in the event that any of the registrants has failed to comply with the obligations of Section 3.1.
4.2.3. Define the order of priorities to fill vacant positions in the judiciary, in accordance with the provisions of Section 5.2.
4.2.4. Dictate internal regulations that ensure the proper functioning of the institution, provided that they do not contradict this law, other regional laws or the Constitution.
4.2.5. Make the formal call for elections for the Presidency, the Vice Presidency and the Disciplinary Board.
4.3. The President and the Vice President will last 1 year in their positions.
Both must be elected by the majority vote of the members of the UCN Bar Association.
4.4. The disciplinary responsibility will fall on the Disciplinary Board of the UCN Bar Association, which will be composed of 3 members:
4.4.1. Two (2) members elected by the majority of the lawyers with definitive registration.
4.4.2. A member elected by the majority of the Supreme Court.
The positions will last 1 year and may be reelected only once.
4.5. The disciplinary sanctions will be:
4.5.1. Call of attention.
4.5.2. Suspension of up to six (6) months in the exercise of the profession.
4.5.3. Registration exclusion.
4.6. The sanctions of articles 4.5.1. and 4.5.2. will require simple majority of the Disciplinary Board. The sanction of article 4.5.3. will require the unanimous vote of the Disciplinary Board. Any sanction of the Disciplinary Bord may be appealed before a Tribunal in accordance with Section 22.1 of the Constitution.


SECTION 5: OF THE PRIORITY TO OCCUPY POSITIONS IN THE JUDICIAL POWER OF THE UCN
5.1. Definitive registration in the UCN Bar Association will grant the right to occupy the positions of judge and Attorney General in case of vacancy.
5.2. If there is more than one applicant to fill a vacancy, the results obtained in the course mentioned in article 2.4, as well as in those that could be created by virtue of article 2.5, will be taken into account for the order of priority.


SECTION 6: PROVISIONAL PROVISIONS
6.1. Those who occupy positions of judge and Attorney General at the time of entry into force of this law will have a period of 2 months to complete the course mentioned in article 2.4.
6.2. Upon the entry into force of this law, the Supreme Court will define from among its members who will occupy the position of President and Vice President.
Once the UCN Bar Association has at least 4 lawyers with definitive registration, the first election will be called to occupy the positions of President, Vice President and members of the Disciplinary Board.
