This proposal seeks to repeal GA Resolution #590 "LEO Force Restrictions". The proposal makes three main arguments against its target. First, that LEO Force Restrictions criminalizes uses of force that is only excessive in retrospect. Second, that its body-worn camera mandate relies on too many assumptions about available technology and the circumstances in which excessive uses of force occur. Third, that its requirement for law enforcement officers provide necessary first aid to people they fatally injure criminalizes as murder any fatal use of force by an officer, even where necessary in self-defense.
While we can agree with the author's analysis that GAR#590 "LEO Force Restrictions" is a flawed resolution, several aspects of this repeal preclude our support. First, instances of rhetoric exist in this proposal that are not universal to all World Assembly member states. Among those, the 'recognition' that there exists "a disturbing history of excessive force exercised by law enforcement toward members of the public", when this is not necessarily the case in all nations to which such legislation applies; second, a small oversight in clause 3a. may constitute an honest mistake, unintentionally misrepresenting the original resolution. Finally, given the immense importance of regulation on this topic to nations that require it, the presence of a replacement should have been an absolute priority before a repeal were submitted.
