The Prime Minister of the Republic of AusValia is the Head-of-State and Head-of-Government of the nation. Serving in this capacity, the Prime Minister represents AusValia and the Government of AusValia abroad, enforcement and implementation of the AusValian Constitution, and ensuring the functioning of the Executive branch of Government. Article II of the AusValia Constitution establishes, the Office of Prime Minister, all its requirements for election, and the duties and responsibilities of the office of Prime Minister. The Office of PM was created in 1787 with the Establishment of the Constitution on July 31st, 1787.

Legislative Powers: The PM is allowed to directly introduce legislation, as well as play an important role in shaping legislation, especially if a Prime Minister's political party has a majority in the Upper or Lower Houses. The PM can further influence the legislative branch through constitutionally-mandated, periodic reports to the legislature. These reports may be either written or oral, but in modern times are given as the State of the Nation address, which often outlines the PM's legislative proposals for the coming year. Pursuant parts of the Constitution, the PM may convene the Legislature. The PM is to decide upon a date to adjourn the Legislature if they cannot decide upon it themselves.

Judicial Powers: The PM also has the power to appoint federal judges, including members of all the nation's High Courts, up until the High Court of AusValia. PM may also grant pardons and reprieves, as is often done just before the end of a presidential term. Executive privilege gives a president the ability to withhold information from the Legislature and federal courts in matters of national security.

Executive Powers:

Foreign Affairs Powers: Perhaps the most important of all Prime Minister's powers is command of the AusValia Military. While the power to declare war is vested in the Legislature, the PM can still deploy AusValian Troops anywhere in the World for up to 150 Days before requesting the approval of the Legislature.

Along with the armed forces, the PM also directs the foreign policy of the Republic of AusValia. Through the AusValia Department of the States and the AusValia Council of Defense, the PM is responsible for the protection of AusValians abroad and of foreign nationals in AusValia. The PM decides whether to recognize new nations and new governments, and negotiates treaties with other nations.

Administrative Powers: The PM is the chief executive of AusValia, putting him/her at the head of the executive branch of the government, whose responsibility is to "take care that the laws be faithfully executed." To carry out this duty, the PM is given control of the millions of employees of the federal government.

A numerous variety of executive branch appointments are made by presidents. Up to 5,000 appointments may be made by an incoming PM before they take office and while in office, the number of appointments they may make, is unlimited. Ambassadors, members of the AusValian cabinet, and other federal officers, are all appointed by a president with the advice and sometimes, consent, of the Upper House.

The PM possesses the ability to direct much of the executive branch through executive orders. To the extent the orders are grounded in federal statute or executive power granted in the Constitution, these orders have the force of law. Thus, executive orders are reviewable by federal courts or can be rendered null through legislative changes to statute.

Vacancy and Disability:

If the position of the PM becomes vacant by either the death or resignation of the PM there is a distinct chain of succession. First in the chain is the PM, followed by the Deputy Prime Minister, The Head of the House, The President of the Upper House, Chief Foreign Diplomat, Director of the Defense Council, and Director of the Treasury Council.

If the PM suffers an accident, physical or medical, that could render them unfit to execute the duties of their position the Legislature is to hold a joint session to determine whether or not the PM can successfully fill the position. If it is determined that the PM cannot continue to rule, the chain of succession shall be followed until an individual fit for the position is found.

Privileges:

Two official residences are provided to the President—The Palace in Jamestown, and the Prime Minister's Camp in Cedar. For transportation, the PM is granted an armored limo and use of two Executive Air Crafts, often referred to as the Prime Minister's and Prime Minister's Helicopter. A division of Law Enforcement Officers, known as the PM Security Detail also furnish constant personal security for the PM and his or her family. All of the aforementioned is supplied by the "People of AusValia" through budgets approved by the Legislature, as is the PM's annual salary of $340,000. (A PM additionally receives a $100,000 expense account, and $100,000 in travel expenses.)
