Australialia Constitution/Puppet State identification/RP Rules

Australialia Constitution


Preamble

The following is the Constitution of Australialia, based off the constitution of the former region, New Zealandia, that must be followed by all members. This constitution will ensure that the democratic values of Australialia are always followed by the Founder, Esceen, and enforced by The Grand Unitary League of Australialia’s Guardians (GULAG). It should be noted that the term limits for regional officers will be under 1 year terms with a non-consecutive rule restricting consecutive terms to two - nations however can run for different regional posts in that time however and re-run for their original post after the end of their successors first term.


Article one: Region founder

Chapter one: Terms
The article recognises the regional founder to be an elected representative to have founded the region. Under the constraints of Nation States restrictions, they are the permanent founder of the region however must therefore meet the following terms:

  • Be an active account on Nation States the definition of which is yet to be stated

  • Be an nation that has been active for at least one month on Nation States

  • Should they wish to retire from their position or Nation States as a whole, must provide the region with at least one weeks’ notice and the means for the region to continue as it is

  • May not be a member of the GULAG or run for the position of regional delegate

Chapter two: Powers and Responsibilities
The chapter states the given administrative powers of the regional founder and their responsibilities as binding by this article:

  • The Founder of Australialia will administrate Australialia until they CTE

  • The Founder shall be responsible for setting and implementing the general in-game policies of the Region

  • The Founder is responsible for the security of Australialia, and may take actions without prior consent of the regional government should a direct threat to regional order be involved

  • The Founder may eject multiple-offense rule breakers, spammers, and raiders without the approval of the regional government

  • It shall be the responsibility of the Founder to explain to the region the justification for any ejection/eject + ban. Any nation may appeal an ejection/ ejection + ban

  • No such ejection shall be grounds for immediately voiding a nations citizenship

  • In the event of a citizens ejection lasting longer than thirty days without repeal, their citizenship shall officially be revoked

  • The founder will have the power to authorise deployments to other regions

  • The Founder may negotiate treaties with foreign regions, organisations, and groups on behalf of Australialia (with the consultation of the WA delegate)

  • The Founder may ‘emergency-pass’ a proposal in the GULAG should it already have some regional support and it be deemed necessary for regional security/order

  • Any emergency-pass, as with other resolutions, may be repealed

  • The Founder shall have the power to pardon or commute the sentence of any individual convicted of a crime against Australialia. Each pardon or commutation is subject to being overridden by the GULAG

  • The Founder may declare a State of Emergency with reasonable justification that a threat to regional security is imminent (E.G: Z-Day, Attempted Coup, Espionage, Raider threat)



    Article two: Regional delegate

    Chapter one: Terms
    The article recognises the regional delegate to be an elected official who represents the region and its interests based on the majority who voted for them. They must meet the following terms:

  • Be an active account on Nation States the definition of which is yet to be stated

  • Be a nation that has been active for at least one month on Nation States and in the region for at least two weeks

  • Should they wish to retire from their position or Nation States as a whole, must appoint the vice-delegate- the definition of which is that of the nation to receive the second highest votes in an election- as the new delegate who must provide elections a maximum of two weeks later.

  • Should the founder be found to be in breach the constitution, may file an complaint to GULAG to launch an inquiry

    Chapter two: Powers and Responsibilities
    The chapter states the given administrative powers of the regional delegate and their responsibilities as binding by this article:

  • The WA Delegate shall serve as the second-in-command of Australialia, holding the most WA endorsements in the Region

  • The Delegate will have the responsibility of attempting to kick all possible threats should the Founder CTE (due to inactivity), if the region is not password-protected (which it should be at all times), or should [insert nation here] be prevented from refounding the region, or if the Founder publicly states otherwise

  • The Delegate is charged with approving WA Proposals on behalf of the entire region



    Article three: GULAG

    Chapter one: Powers and Responsibilities

  • The legislating body of Australialia, The Grand Unitary league of Australialia’s Guardians, shall be the sole legislative body in the region, charged with all legislative power and responsibility

  • For proposals to pass through the GULAG, there must be at least 6 of the members in the GULAG who approve of the disputed resolution

  • It is the responsibility of the Founder to update the GULAG status

  • If a proposal does not reach the required number of endorsements within one month of its posting, it shall be classed as defeated and removed from the floor

  • Nations can be ‘commended’ or ‘condemned’ via the GULAG

    Chapter two: Membership

  • All residents are automatically and permanently GULAG members hence giving them a say in regional affairs and ensuring the responsibility of resident nations for crimes they are convicted of while part of the region



    Article four: Resident rights

    Chapter one: Rights
    The article recognises the rights and responsibilities of resident nations as well as the requirements to be accepted into the region. Resident rights include:

  • The right to vote for the regional delegate

  • The right to run for GULAG membership

  • Freedom from punishment without an inquiry conducted by GULAG

  • The right to run for delegacy if they meet the requirements to be eligible to run for that position

  • The right to host RP’s

  • Defines all Australialia Citizens as ‘natives’, or those nations who have strong ties to Australialia

  • All Nations of Australialia are recognized as sovereign. Each Nation has the right of self-determination in that Nation's domestic policies, including, but not limited to, issue selection, World Assembly Resolution Stance, United Australialia Proposal Stance, Political Ideology, or former Raider Alignment

  • All nations shall have the right to freedom of speech and expression, subject to reasonable restrictions imposed by law which do not violate the spirit of this Constitution (i.e. spam, flaming, and unacceptable language)

  • Nations will have the right to due process of law and equal protection under the law

  • All nations have the right to contact the government for assistance on any matter

  • When charged with criminal acts, Australialia members shall have a fair, impartial, and public trial before either the GULAG (if the crime is not deemed an immediate risk to regional security) or in a closed-doors trial by the government (if an immediate security risk is involved).

  • Nations will have the right to apply and vote for government positions provided they meet eligibility requirements imposed by Founder.

  • All former raiders granted citizenship must not use Australialia or Australialia Defender Army regions as a base/jump-point. They must also admit to the entire region their raiding past to ensure regional security. No current Raiders can be granted citizenship.

    Chapter two: Responsibilities
    Resident nations are obliged to meet the following responsibilities:

  • All WA members endorse the elected delegate and though may endorse any other WA member may not if it removes the current delegate from their position

  • Although not legally binding, residents are obliged to vote in elections though can do as they wish in any other poll

    Chapter three: Eligibility
    To be granted resident rights, a nation must meet the following needs:

  • Has been on Nation States for at least one month

  • Is not a puppet state, and lists any and all of their puppet states present in the region- this does not apply to any of their puppet states in other regions



    Article five: Regional government

    Chapter one: Powers and responsibilities
    The Article recognises the use of the regional government, employed to oversee the day-to-day management of the region of Australialia. Their powers and responsibilities include:

  • The Regional Government shall be responsible for the day-to-day administration of the region

  • The Founder shall be responsible for appointing a Minister for Security to assist in the management of Australialia and may freely dismiss them

    Chapter two: Terms

  • The Founder shall be the Head of Government and be responsible for the administration of the executive government

  • The Regional Government shall consist of the Founder (eternal), WA Delegate (long-term), and Regional Ministers (voted by regional citizens)

  • The Founder and Delegate are not permitted to serve in any other position apart of the Regional Government


    Article six: Amendments

    Chapter one: Eligible amendments

  • The GULAG may make amendments to this Constitution only with 100% approvals

  • The Founder may not make amendments to this Constitution without having at least 50% of the region in approval/to witness the amendment should the GULAG not act



    Article seven: Constitutional power

    Chapter one: Jurisdiction

  • This Constitution shall have supremacy over all other laws

  • No law or government policy may contradict this constitution



    Article eight: Minister for Security (Currently Minister for Evil Affairs)

    Chapter one: Terms

    The article recognises the Minister for Security to be an elected representative to act in accordance with protecting the region. To be eligible for said position, they must:

  • Be an active account on Nation States the definition of which is yet to be stated

  • Be a nation that has been active for at least one month on Nation States

    Chapter two: Powers and Responsibilities

    The chapter states the given administrative powers of the Minister for Evil affairs and their responsibilities as binding by this article:

  • The Minister for Security is responsible for the security of Australialia in conjunction with the delegate and founder, and may take actions without prior consent of the regional government should a direct threat to regional order be involved

  • The Minister for Security may eject multiple-offense rule breakers, spammers, and raiders with the approval of the regional government

  • It shall be the responsibility of the Minister for Evil affairs to explain to the region the justification for any ejection/eject + ban acted out by the minister. Any nation may appeal an ejection/ ejection + ban

  • No such ejection shall be grounds for immediately voiding a nation’s citizenship



    Article nine: Immigration

    Chapter one: Terms

    The article recognises the requisites for immigration by nations that have existed for longer than one month to move into Australialia and the grounds on which full voting rights can be admitted to immigrant nations. These include:

  • Agreeing to a three month minimum residency

  • Notifies regional founder of their arrival and any other nation they may know

  • Notifies the region of their arrival by lodging a post

  • Not be a puppet state of another nation

  • Read the entirety of the constitution – I know you won’t but f*** it

    Chapter two: Immigrant Rights

    The chapter states the rights granted to new members upon joining the region. These include:

  • A nation immigrating during an election shall not immediately receive the right to vote, but rather must either wait until 24 hours after they fulfilled the above terms, or until the regional founder approves their immigration. The first of these two conditions to be fulfilled shall grant the immigrant the right to vote

  • If the legitimacy of such an immigrant is questioned, or the above terms are violated, a nation may call for a trial. Should it be proven that the terms of this article were violated, the immigrant shall face immediate ejection, and if nations within the region invited them, they may be further charged with crimes against Australialia. Any votes or actions which the immigrant partook in shall be examined as well, and the GULAG shall decide whether or not any resulting policies or decisions require nullification or revision

  • A nation who immigrates during an election can no longer be tried for violating the terms of this article if they remain in the region for their three month minimum. Should an immigrant reach their three month minimum while in the process of being tried, their resident rights shall be withheld until the trial rules that they are innocent. If guilty, their resident rights shall be cancelled in accordance with their ejection from the region

  • Should a nation be ejected for improper immigration during an election, they must obtain majority approval of the region in order to enter again, and shall be on parole for a month, during which time they shall not be allowed to vote or run for office

    Role Playing Rules

    Military size and budget:

  • The Military size and budget are determined by the ranking of your military and the government expenditure. 10,000 in the Defence Force Ranking equal 1,000,000 regular troops although this doesn’t include reservists and militia who can only fight on a nation’s mainland. Budget and size must both be taken into consideration to also note the quality of the military.


    Arms Manufacturing and Automobile Industry:

  • Affects the ability to replenish Arms, Munitions and vehicles in a nation’s military. If a nation wishes to import from another nation then the particular industry the exporting nation has must be larger than the importing nation. And importing nation can see its supply of arms, munitions and vehicles disrupted under circumstances of a blockade for example.


    Geography:

  • Essentially look at a map before you go to war. If you’re sustaining an effective invasion of an unclaimed part of the globe with a large fleet along the coastal regions of that area then that’s perfectly fine. If you’re sustaining an invasion against an existing nation with your nearest supply base thousands of miles away then that’s bollocks (bear in mind any nearby allies do count as using supply bases for you).


    Weaponisation:

  • This will determine a nation’s ability to defend its homeland. A nation with low Weaponisation would see only really the military putting up a fight in the mainland however high Weaponisation nations will see large resistance movements in support of the defending military force.


    Legitimisation:

  • For an rp to be legitimate and canon both parties involved in the rp must consent to its being so. If one party does not then the rp is non-canon. In addition any violations of these rules will hence be declared non-canon

  • In addition RP's in which a nation invades an NPC are subject to intervention to other nation's without the original nation's consent. Exception to this lies in if that NPC already lies with the sphere of influence of the original nation (note: that land may stay be claimed by new nation's later on)


    Scientific Advancement:

    50 - Cold War
    100- Current Tech, China-Russia
    200- Current Tech, NATO
    Above 300- 2020-2030

  • Note: To avoid any unfair affects of scientific advancement on nation's any nation may import arms or vehicles for their militaries from a nation with higher scientific advancement and a larger arms/automobile manufacturing sector than their own. This will bring that nation's scientific advancement up to the same level as the exporting nation. Both the importer and exporter must agree however to an arms trade and state this either in the rmb or their factbooks (nothing big, just say your trading and that's all that's required).


    Military Branches:

  • The size of a particular branch of the military depends on the geography of a nation - the more a nation is based around the coast the larger their navy is and the smaller their army, the more land a nation possesses the larger their army is and smaller their navy is. The air force is unaffected by this and so the branch size of the air force is decided by each nation.
